National technical regulation on industrial emissions in Vietnam from July 01, 2025

The National Technical Regulation on Industrial Emissions in Vietnam from July 1, 2025, will be implemented according to the technical regulation QCVN 19:2024/BTNMT issued together with Circular 45/2024/TT-BTNMT. This regulation will be officially applied from July 1, 2025.

Note: For facilities already in operation, investment projects that have received approval of the environmental impact assessment report or have been fully received by competent state agencies for the assessment of the environmental impact report, issuance of environmental licenses, or environmental registration (hereinafter collectively referred to as ongoing investment projects) prior to the effective date of Circular 45/2024/TT-BTNMT will continue to apply existing national environmental technical standards on emissions according to the type of production, business, and service, and the regulations of the local government (including local environmental technical standards on emissions) until December 31, 2031.

In cases where competent state agencies issue regulations related to changes in regional, area coefficients (Kv), the mentioned entities will follow the schedule specified by the competent state agency when issuing the above regulations.

Regarding the implementation schedule:

- From the effective date of Circular 45/2024/TT-BTNMT, investment projects (including new investment projects, projects expanding scale, increasing capacity that submitted dossiers for environmental impact assessment reports, environmental licenses, and environmental registration after the effective date of Circular 45/2024/TT-BTNMT) must comply with the regulations in QCVN 19:2024/BTNMT.

- From January 1, 2032, the aforementioned cases must meet the requirements specified in QCVN 19:2024/BTNMT, unless the provincial People's Committee issues a schedule for earlier implementation.

- The aforementioned cases are encouraged to apply the regulations in QCVN 19:2024/BTNMT starting from the effective date of Circular 45/2024/TT-BTNMT.
