- Individuals working under an indefinite-term labor contract, a definite-term labor contract, a seasonal labor contract or a specific task contract with a duration from a full 03 months to less than 12 months, including labor contracts signed between employers and lawful representatives of individuals under 15 years old in accordance with the labor laws;
- Individuals working under a labor contract with a duration from a full 01 month to less than 03 months;
- Officials and public employees;
- National defense workers, police workers, and individuals performing other tasks in cipher organizations;
- Officers and professional soldiers of the People's Army; officers, non-commissioned officers engaged in technical expertise, and non-commissioned officers specialized in technical tasks of the People's Police; individuals performing cipher tasks and receiving salaries equivalent to soldiers;
- Non-commissioned officers and soldiers of the People's Army; non-commissioned officers and soldiers of the People's Police serving for a fixed term; military, police, and cipher students currently studying and receiving living expenses;
- Individuals working abroad under contracts as stipulated in the Law on Vietnamese Laborers Working Abroad Under Contracts;
- Managers of enterprises, managers of cooperative societies receiving salaries;
- Individuals performing non-specialized tasks at commune, ward, and commune-level town.
- Foreign laborers working in Vietnam with a work permit or a practicing certificate or a practicing license issued by a competent authority of Vietnam who are required to participate in compulsory social insurance as stipulated by the Government of Vietnam.
Among those, the groups of laborers working under a contract from a full 01 month to less than 03 months and foreign laborers are the two groups that the law additionally requires to participate in compulsory social insurance from January 01, 2018.
| Moreover, based on the aforementioned contents and in conjunction with current regulations, we can deduce 02 cases where laborers are not required to participate in social insurance, which are:
Not falling under any of the cases required to participate in social insurance as stipulated in [Clause 1 and Clause 2, Article 2 of the Social Insurance Law 2014](https://lawnet.vn/vb/luat-bao-hiem-xa-hoi-2014-3f674.html), or;
Falling under the case of not working and not receiving a salary for 14 days or more in a month as stipulated in Clause 3, Article 85 of the Social Insurance Law 2014.
