Subjects of administrative violations on water resources and minerals must pay for expert assessment fees

This is the new noteworthy remedial measure in Decree 36/2020/ND-CP on administrative penalties in the field of water resources and minerals.

This Decree has added remedial measures for violations in the field of water resources and minerals.

To be specific, point s, Clause 3, Article 4 of Decree 36/2020/ND-CP stipulates:

  1. Remedial measures:

For each administrative violation, in addition to the application of main penalties, supplementary penalties, the violating organizations or individuals may be subject to one or more of the following remedial measures:

...

s) Compulsory payment of expenses for inspection, assessment, and measurement in case of violations;

At present, Decree 33/2017/ND-CP does not address the issue of inspection cost payment. Therefore, it can be seen that the addition of the inspection cost payment to the group of remedial measures is a very sensible viewpoint of the Government of Vietnam.

The regulation compulsory payment of inspection expenses not only creates additional revenue for the state budget but also reduces the cost of pollution inspection and ensures that organizations and individuals involved in the field of water resources and minerals strictly comply with legal regulations. Because, if it is determined that there has been a violation, in addition to paying the fine, they may also incur the inspection costs.
