Guidelines for payment of maintenance costs for inland waterway transport infrastructure assets based on performance quality in Vietnam from January 01, 2025

According to Circular 37/2024/TT-BGTVT, the contractor is entitled to payment in the settlement period corresponding to the acceptance score achieved. Additionally, during the Contract implementation period, the contractor's points achieved will be reduced in the following circumstances:

- A deduction of 25% of the remaining points for the month's work item upon the second evaluation scoring below 75%;

- A deduction of 50% of the remaining points for the month's work item upon the third evaluation scoring below 75% or the second evaluation scoring below 50%.

Furthermore, consideration will be given to terminate the contract and disallow participation in bidding for the management and maintenance of inland waterway transport infrastructure assets in the following year if any work item is evaluated to score below 75% for the fourth time or below 50% for the third time.

For field issues identified upon acceptance which the contractor has not remedied within the stipulated time frame set out in Annex 1 attached to Circular 37/2024/TT-BGTVT, the unresolved portion will be added to the monitoring and acceptance result of the subsequent month, which remains incomplete.

The contractual value for each work item on the waterway section, sub-section will be evenly distributed across the months as a basis for payment and deduction of funds.
