Regulations on the organization and implementation of land surveying, assessment in Vietnam

Article 10 of Decree 101/2024/ND-CP stipulates the organization and implementation of land surveying, assessment in Vietnam:

(1) Developing and approving the task of land surveying, assessment:

- Collecting and processing information and documents serving the development of land surveying, assessment tasks;- Determining the objectives, content, and volume of land surveying, assessment;- Preparing budget estimates based on the content and volume of work;- Submitting the investigation and evaluation tasks for approval by the competent authority.

(2) Selecting consulting organizations to perform, check, and supervise.

(3) Carrying out the task of land surveying, assessment:

- Collecting information, documents, data, and maps;

- Organizing field investigations and sampling;

- Summarizing and processing the information and documents.

(4) Developing datasets, maps, and reports on land surveying, assessment results:

- Preparing reports on the results of land quality evaluation, land potential, land degradation, and land pollution;

- Developing data sets of results on land quality evaluation, land potential, land degradation, and land pollution;

- Preparing maps of land surveying, assessment results, including: nationwide maps on land quality evaluation, land potential, land degradation, and land pollution based on the current land use maps of the same period at scales of 1/1,000,000 - 1/250,000; provincial maps on land quality evaluation, land potential, land degradation, and land pollution based on the current land use maps of the same period at scales of 1/100,000 - 1/25,000;

- Finalizing the land surveying, assessment data and updating it into the national land database.

(5) Soliciting feedback on land surveying, assessment results:

- Nationwide and regional tasks: The responsible agency solicits feedback from relevant agencies on the results of land surveying, assessment;

- Provincial tasks: Provincial land management functions submit feedback requests to the Ministry of Natural Resources and Environment regarding the land surveying, assessment results;

- Feedback solicitation files are stipulated under Clause 1, Article 14 of Decree 101/2024/ND-CP.

Conditions on the Competence of land surveying and assessment service provider in Vietnam

Specifically, Article 17 of Decree 101/2024/ND-CP stipulates the conditions on the competence of land surveying and assessment service provider in Vietnam as follows:

(1) Consulting service organizations are eligible to conduct land surveying, assessment when they meet any of the following conditions:

- Public non-business units with functions and tasks to perform consulting services for land surveying, assessment must have at least one expert meeting the conditions specified in Point a or Point b, Clause 2, Article 17 of Decree 101/2024/ND-CP and at least two experts meeting the conditions specified in Point c or Point d, Clause 2, Article 17 of Decree 101/2024/ND-CP; and must rent analysis and testing labs meeting the conditions specified in Clause 3, Article 17 of Decree 101/2024/ND-CP.

- Enterprises with registered business in consulting services for land surveying, assessment must have at least one expert meeting the conditions specified in Point a or Point b, Clause 2, Article 17 of Decree 101/2024/ND-CP and at least two experts meeting the conditions specified in Point c or Point d, Clause 2, Article 17 of Decree 101/2024/ND-CP; and must rent analysis and testing labs meeting the conditions specified in Clause 3, Article 17 of Decree 101/2024/ND-CP.

(2) The lead consultants for provincial-level land surveying, assessment must hold a university degree and have at least 30 months' experience in one of the fields related to soil science, agricultural chemistry, environment, land management, or other relevant fields, and meet one of the following conditions:

- Have led at least one project or task in land surveying, assessment nationwide or in economic-social regions;- Have led at least three provincial-level projects or tasks in land surveying, assessment;- Have directly participated in at least one project or task in land surveying, assessment nationwide or in economic-social regions;- Have directly participated in at least three provincial-level projects or tasks in land surveying, assessment.

(3) Units performing soil and water sample analysis must have analysis labs licensed by competent authorities to conduct analysis and testing of soil and water samples (excluding sampling activities) as per legal regulations.

(4) The selection of consulting organizations for land surveying, assessment is carried out according to legal regulations on task assignment, ordering, or bidding for providing public service products using state budget funds from regular expenditures.
