On September 23, 2024, the Ministry of Labor, War Invalids and Social Affairs issued Official Dispatch 4452/BLDTBXH-CTE implementing regulations on the care of children in Vietnam.

Instruction on implementing regulations on the care of children in Vietnam

To ensure children's rights and effectively implement the Law on Children and related legal provisions on child protection, prevention, and combat of violence, abuse, and exploitation, the Ministry of Labor, War Invalids and Social Affairs of Vietnam requests that the People's Committees of provinces and centrally affiliated cities direct local authorities and People's Committees at all levels to implement the following contents:

- Organize inspections, examinations, and reviews of all public and non-public social support establishments that provide care and nurture for children in the locality, ensuring compliance with the Law on Children and related legal provisions on admission procedures, care, and implementation of alternative care forms in the best interest of each child; standards and operational conditions; management of social mobilization resources in these establishments; handle promptly and strictly non-registered, spontaneous, unlicensed establishments or those that do not meet the care and nurture conditions for children as regulated by the law.

- Based on the actual situation in the locality, ensure that social support establishments utilize technology and technical equipment to continuously (24h/24h) monitor and supervise the care and nurture of children; share and update data on child care and protection with competent authorities in supervising and protecting children's rights at these establishments.

- Effectively implement Decree 110/2024/ND-CP on social work, aiming to build a professional network of social workers to enhance prevention, care, and protection of children at social support establishments and within the community.

- Intensify public communication, raising the responsibility of citizens, levels, and sectors in detecting, reporting, and handling violations of children's rights.

- Direct the development and submission of policies to the People's Councils for issuance according to authority, ensuring personnel for child care and protection work; urge commune-level People's Committees to assign officials for child protection within the commune's official or non-specialized staff, ensuring working time and capacity to implement child protection regulations stipulated by the Law on Children and Decree 56/2017/ND-CP which details certain provisions of the Law on Children.

Report the results of inspections and examinations of social support establishments that provide care and nurture for children (through the Department of Children) to the Ministry of Labor, War Invalids and Social Affairs before November 6, 2024, so that the ministry can compile and report to the Prime Minister of Vietnam.
