1. Procedures for proposing innovation and creativity for officials in Vietnam under Decree 73/2023

The procedures for proposing innovation and creativity for officials in Vietnam according to Article 7 Decree 73/2023/ND-CP are as follows:

- Officials with innovative and creative ideas must develop a proposal plan for innovation and creativity as prescribed in Clause 2, Article 7 Decree 73/2023/ND-CP.

- The proposal plan for innovation and creativity includes the following basic contents:

+ The necessity, purpose, and requirements of the innovation and creativity proposal, clearly showing the bottlenecks and hurdles in mechanisms and policies not yet regulated in the legal documents of the Government of Vietnam, the Prime Minister of the Government of Vietnam, ministries, ministry-level agencies, and localities;

+ Proposed contents, tasks, solutions for innovation, and creativity; scope, implementation subjects for tasks and solutions; implementation duration and secured resources; feasibility of the proposed content;

+ Assessment of the positive and negative impacts of the proposed innovation and creativity content (if any); anticipated effectiveness of the proposal when implemented in reality.

- The proposal plan for innovation and creativity by the official must be submitted to the head of the employing agency for review and decision, except as prescribed in Clause 4, Article 7 Decree 73/2023/ND-CP.

- The proposal plan for innovation and creativity by the head of the employing agency must be submitted to the head of the superior employing agency for review and decision.

2. Procedures for approving proposals for innovation and creativity for officials in Vietnam according to Decree 73/2023

The procedures for approving proposals for innovation and creativity for officials according to Article 8 Decree 73/2023/ND-CP are as follows:

- For innovation and creativity proposals prescribed in Clause 3, Article 7 Decree 73/2023/ND-CP, within 7 working days from the date of receiving the proposal plan, the head of the employing agency must convene a meeting with the leadership collective to review, discuss, and vote on the proposal’s implementation.

The proposal is approved when it receives over 50% affirmative votes. In case of a tie, the decision shall follow the vote of the head. The leadership collective participating in the vote includes the head and deputies of the head of the employing agency, excluding the deputy who has the innovation and creativity proposal.

In cases where the content of the innovation and creativity proposal is not approved by the leadership collective of the employing agency according to this provision, the head of the employing agency may decide to proceed with the proposal if it is deemed necessary, feasible, and will be responsible before the superior employing agency and the law for their decision. The decision to proceed with the proposal by the head of the employing agency must be documented in writing.

- For innovation and creativity proposals with a wide scope, complex content, involving multiple fields, and affecting many subjects, if necessary, within 10 days from the date of receiving the proposal plan, the head of the employing agency shall establish a Proposal Evaluation Council as prescribed in Article 9 Decree 73/2023/ND-CP to review and decide.

- For innovation and creativity proposals prescribed in Clause 4, Article 7 Decree 73/2023/ND-CP, the head of the proposing agency shall report to the head of the superior employing agency for review and decision. The head of the superior employing agency is responsible for reviewing the innovation and creativity proposal as prescribed in Clauses 1 and 2, Article 8 Decree 73/2023/ND-CP.

- Within 3 working days from the date of concluding the leadership collective meeting for proposals prescribed in Clause 1, Article 8 Decree 73/2023/ND-CP, the head of the employing agency shall report and seek opinions from the same-level party committee or party organization on the outcome of the leadership collective meeting. The head of the employing agency, based on the opinions of the same-level party committee or party organization, shall issue documents on the approval or non-approval of the proposal’s implementation; in case of approval, assign the proposing official or other individuals and organizations to implement it.
