1. Guidelines for organizing transport operation training for transport business drivers in Vietnam

According to Article 12 of Decree 158/2024/ND-CP, the guidelines for organizing transport operation training for transport business drivers in Vietnam are as follows:

- Training subjects: drivers engaged in transport business.

- Framework contents for providing knowledge about transport operations.

+ Minimum amount of knowledge and training duration:

Minimum amount of knowledge: 4 lessons (from lesson 1 to lesson 4); minimum training duration: 24 hours;

- Timing for training:

+ Before drivers participate in transport business activities;

+ Periodically not exceeding 5 years from the date of training certification issuance.

- Training officers must meet one of the two following requirements:

+ Transport-specialized teachers from intermediate schools and above that provide road transport training; individuals with a transport specialization qualification from intermediate level or higher;

+ Individuals with a higher education level in other specializations and a minimum of 3 years experience in managing and operating road transport.

- The transport business units are responsible for organizing transport operation and traffic safety training for their drivers and meet the following requirements:

+ Ensure compliance with the content stipulated in Clauses 1, 2, 3, and 4 of Article 12 Decree 158/2024/ND-CP;

+ During the organization of training, transport business units are allowed to cooperate with other transport units, Vietnam Automobile Transport Association, local automobile transport associations, driver training institutions, and training schools from intermediate level and above (schools with a transport specialization) to organize training for drivers;

+ When organizing training, the organizing unit must notify the local Department of Transport 5 working days in advance about the training plan, venue, list of training officers, and list of participants for supervision and inspection;

+ Forms of training: direct or online.

- Training organization unit:

+ Transport business units can organize training themselves or in cooperation with units specified in Point b, Clause 5, Article 12 Decree 158/2024/ND-CP to organize training for drivers as per regulations;

+ Before organizing training, the transport business unit, local automobile transport association, or driver training institution (training organizing unit) must develop a training plan that includes: organizing classes according to local demand, arranging the number of driver training classes accordingly; for drivers, classes can be divided by transport specialization such as goods, passengers, or organized generally; allocate time, venue, list of training officers, timetable of lectures, contact phone number, and must report to the local Department of Transport for supervision and inspection;

+ The organizing unit must manage, supervise the training process, inspect, and award certificates to individuals who have completed the training according to the prescribed form in Appendix VI attached to Decree 158/2024/ND-CP; store the training program documentation and results for at least 3 years.

- Organizing examination and awarding Certificates:

+ The organization of the examination is conducted as follows:

Participants must ensure full attendance during the learning period to qualify for the examination. At the end of the training program, a test must be completed within 120 minutes. The final test score is graded on a scale of 10, with a score of 5 or higher being satisfactory;

+ Centralized examination format; tests are completed on paper;

+ Training Completion Certificates: Transport business drivers who score 5 or higher on the test will be issued a Training Completion Certificate by the organizing unit as per Point c, Clause 6, Article 12 Decree 158/2024/ND-CP. Drivers scoring below 5 will have an opportunity to retake the test at least 5 working days after each training session. The certificate is valid for 5 years from the date of issue.

- Department of Transport:

+ Assign officers to inspect directly or through online monitoring cameras the training sessions organized by units;

+ Revoke training results and require retraining as defined if the organizing unit fails to notify the Department of Transport as per Point c, Clause 5, Article 12 Decree 158/2024/ND-CP or fails to meet the requirements in Point a, Clause 5, Article 12 Decree 158/2024/ND-CP.

- The Directorate for Roads of Vietnam compiles and publishes the materials and framework program for transport operation training for transport business drivers.

2. Conditions for passenger transport business by automobile in Vietnam

The conditions for passenger transport business by automobile as per Article 13 Decree 158/2024/ND-CP are as follows:

- Passenger transport business automobiles must be owned or under lawful use according to a written vehicle hire contract between the passenger transport business unit and organizations or individuals, or a business cooperation contract according to legal regulations. In the case of a vehicle registered under a cooperative member, there must be a service contract between the member and the cooperative, specifying that the cooperative has the right, responsibility, and obligation to manage, use, and operate the member's vehicles.

- Transport business automobiles must be equipped with a journey monitoring device, an image recording device for drivers according to Clause 2, Article 35 Road Traffic Order and Safety Law 2024.

- Fixed-route passenger transport automobiles must have a seating capacity of 8 seats or more (not including the driver's seat) and the following age limits: no more than 15 years for vehicles operating on routes over 300 kilometers, no more than 20 years for vehicles operating on routes of 300 kilometers or less.

- Bus passenger transport automobiles must have a seating capacity of 8 seats or more (not including the driver's seat) and a lifespan of no more than 20 years.

- Taxi passenger transport automobiles must have a seating capacity of fewer than 8 seats (not including the driver's seat) and a lifespan of no more than 12 years. Vehicles designed or modified to have fewer than 8 seats from larger vehicles (not including the driver's seat) cannot be used for passenger transport by taxi.

- Contract-based passenger transport automobiles with more than 8 seats (not including the driver's seat) have the following lifespan limits: no more than 15 years for vehicles operating on journeys over 300 kilometers, no more than 20 years for vehicles operating on journeys of 300 kilometers or less.

Contract-based passenger transport automobiles with fewer than 8 seats (not including the driver's seat) using electronic contracts have a lifespan of no more than 12 years.
