Regarding this issue, LawNet would like to answer as follows:

1. Who is the Border Guard?

According to Clause 1, Article 13 of the Law on Vietnam Border Guard 2020, the Border Guard is the people's armed force, a component of the Vietnam People's Army, and is the core force in charge of managing and protecting national borders and border areas.

In which, Border Guard officers and soldiers include officers, professional soldiers, defense workers and officers, non-commissioned officers and soldiers on the payroll of the Border Guard.

(Clause 5, Article 2 of the Law on Vietnam Border Guard 2020)

2. Preferential policies and special regimes for Border Guard officers and soldiers in Vietnam

Specifically, in Article 4 of Decree 106/2021/ND-CP, Border Guard officers and soldiers will enjoy the following preferential policies and special regimes:

(1) Officers, professional soldiers, workers, and defense officers of the Border Guards performing the task of protecting borders and islands for 5 years or more, if there is a need to move their family to settle down and settle down for a long time in border areas or islands, priority shall be given to the allocation of residential land by the local authorities where they move to according to the provisions of the land law;

Accommodation assistance, family housing, employment for spouses of Border Guard officers, professional soldiers, workers, and defense officers, as well as other regimes and policies as prescribed by regulations.

(2) Border Guard officers and soldiers are not entitled to salary, allowances, or other policies in the Army; they are also entitled to an allowance for their responsibility for border and island protection during the time they are directly in charge of managing and protecting borders and islands.

(3) Officers, professional soldiers, workers, and defense officers of the Border Guard who have worked continuously for a full five years or more in the land border areas, islands, and archipelagoes, monthly allowance for long-term work in the border and islands.

Where the allowance regime for long-term work on the border and islands is specified in many documents, only the highest level of such a regime or policy shall be enjoyed.

(4) Officers and professional soldiers of the Border Guard are entitled to a monthly allowance for part-time work when working as reinforcement officers in border communes where socioeconomic conditions are particularly difficult, and the annual health promotion regime is increased in accordance with the provisions of law.

3. Tasks of Vietnam Border Guard

Border Guard officers and soldiers are responsible for performing the following tasks:

- Collect information, analyze, evaluate, and forecast the situation to perform tasks and propose to the Ministry of National Defense, the Party and the State to promulgate and direct the implementation of policies and laws on border guard.

- Provide advice to the Ministry of National Defense on national border management and protection, including maintaining security, social order, and safety in border areas and at border gates, as well as building the Border Guard force.

- Manage and protect national borders, the system of national landmarks, markers, border signs, border works, and border gates; organize the inspection of the implementation of the law on border guards.

- Maintain security, social order, and safety by preventing, detecting, and combating hostile forces' operating methods and tricks, preventing and combating crimes, and violating the law; and protecting the lawful rights and interests of agencies, organizations, and individuals in border areas and at border gates.

Control entry and exit at the Ministry of National Defense-managed border gate, as well as border crossing in accordance with the law.

- Carry out international cooperation on border guard and border guard diplomacy; settle border and border gate events in accordance with law.

- Propagate, disseminate and educate the law, mobilizing the people to implement the Party's guidelines and guidelines, and the State's policies and laws.

- Be prepared to fight, to fight against armed conflict, to fight in border areas.

- Advise and act as the core in building an all-people border defense and all-people border defense posture in border areas; participate in the construction of defense zones at provincial, district and border levels, and civil defense.

- Receive and use human resources and civil means to perform tasks as prescribed by law.

- Participate in building the grassroots political system, arranging and stabilizing the population, building the infrastructure system, developing socio-economics, and implementing policies on ethnicity and religion in border areas in association with building and consolidating national defense and security.

- Participate in the prevention, combat, response and overcoming of incidents, natural disasters, disasters, climate change, epidemics; search, rescue and rescue in border areas.
