1. Who is the Border Guard?

According to Clause 1, Article 13 of the Vietnam Border Guard Law 2020, the Border Guards are the people's armed forces, a component of the Vietnam People's Army, and are the core force in charge of managing and protecting national borders. country's border area.

2. Tasks of the Border Guard in Vietnam

The tasks of the border guard according to Article 14 of the Vietnam Border Guard Law 2020 are as follows:

- Collecting information, analyzing, evaluating, and forecasting the situation to perform tasks and propose them to the Ministry of National Defense, the Party, and the State to promulgate and direct the implementation of policies and laws on border guard.

- Advising the Ministry of National Defense on the management and protection of national borders; maintaining security, social order, and safety in border areas and border gates; and building the Border Guard force.

- Managing and protecting national borders, system of national landmarks, markers, border signs, border works, and border gates; organizing the inspection of the implementation of the law on border guard.

- Maintaining security, social order, and safety; preventing, detecting, stopping, and fighting against the operating methods and tricks of hostile forces; preventing and combating crimes and violating the law; protecting the lawful rights and interests of agencies, organizations, and individuals in border areas and border gates in accordance with the law.

- Controlling entry and exit at Ministry of National Defense-managed border gates, as well as border crossing in accordance with law.

- Carrying out international cooperation on border guard and border guard diplomacy; settling border and border gate events in accordance with the law.

- Propagating, disseminating and educating the law; mobilizing the people to implement the guidelines of the Party; policies and laws of the State.

- Ready to fight, fight against armed conflict, war of aggression in border areas.

- Advising and acting as the core in building an all-people border defense and all-people border defense posture in border areas; participating in the construction of defense zones at provincial, district, and border levels; and civil defense.

- Receiving and using human resources and civil means to perform tasks as prescribed by law.

3. Powers of Border Guards in Vietnam

The powers of the Border Guard under Article 15 of the Vietnam Border Guard Law 2020 include:

- Arranging and using forces, means and technical equipment to perform tasks; applying forms and measures to manage and protect national borders as prescribed in Articles 19 and 20 of the Law on Vietnam Border Guard 2020.

- Patrol, inspect, control, manage, and protect national borders; system of national landmarks; markers, border signs, border works, and border gates; grant, amend, supplement, and cancel visas and other papers in the field of national border management and protection;

Inspecting and controlling vehicles when there are signs of law violations; handling law-breaking vehicles in border areas and border gates in accordance with the law.

- Fighting, preventing, investigating, and handling law violations in border areas and border gates in accordance with the law.

- Limiting or suspending activities at border belts, border areas, border crossings at border gates and openings as prescribed in Article 11 of the Law on Vietnam Border Guard 2020.

- Using weapons, explosives, and combat gear as prescribed in Article 17 of the Law on Vietnam Border Guard 2020.

- Mobilizing people, ships, vehicles, and civil technical equipment according to the provisions of Article 18 of the Law on Vietnam Border Guard 2020.

- Directly chasing and arresting law-breaking people and means from the border to the inland; coordinating with forces in tracing and arresting law-breaking people fleeing inland;

Pursuing and arresting law-breaking people means fleeing from the internal waters or territorial waters of Vietnam outside the territorial sea of Vietnam in accordance with Vietnamese law and international treaties to which the Socialist Republic of Vietnam is a signatory.

- Cooperating and coordinating with functional forces of bordering countries, other countries and international organizations in management; protecting national borders, border gates, preventing and combating crimes and law violations according to the provisions of Vietnamese law and international treaties to which the Socialist Republic of Vietnam is a signatory.
