Regarding this issue, LawNet would like to answer as follows:

1. Position and functions of the Economic Department, or the Economic and Infrastructure Department in Vietnam

- The Department of Economics or the Department of Economics and Infrastructure is a specialized agency under the district-level People's Committee, advising and assisting the district-level People's Committee in performing the function of state management of industry and trade in the locality (for other fields under the Economic Department or the Economic and Infrastructure Department guided by the respective industry management ministry).

- The Economic Department, or the Economic and Infrastructure Department, has legal status, its own seal, and an account; it complies with the direction and management of the organization, staffing, and work of the district-level People's Committee; and at the same time, it complies with the direction, inspection, and professional guidance of the Department of Industry and Trade.

2. Duties and powers of the Economic Department or the Economic and Infrastructure Department in Vietnam

Duties and powers of the Economic Department or the Economic and Infrastructure Department are specified in Article 4 of Circular 04/2022/TT-BCT, including:

- Submit to the District People's Committee: draft decision; medium-term and annual development plans; programs and measures to organize the implementation of state administrative reform tasks in the field of industry and trade.

- Submit to the Chairman of the District People's Committee the draft decision and other documents under the promulgation authority of the Chairman of the District People's Committee as assigned.

- Organize, guide, and implement policies to encourage collective economic organizations and private economic organizations to invest in industrial development and expand production and business; organize technology transfer consulting services; provide information; promote trade; and provide human resource training for production and business establishments in the field of industry and trade. Implement trade promotion programs and plans, and build and develop brands in the area as assigned by competent authorities.

- Advise and help the district People's Committee implement state management of industrial clusters in the district:

+ Being the focal point to help the District People's Committee manage industrial clusters in the district according to decentralization and provisions of law; Organize and implement industrial cluster development activities in district-level areas according to regulations;

+ Propose to develop plans to develop, establish, and expand industrial clusters in the area;

+ Coordinate with the Commune People's Committee to carry out land recovery, land lease, site clearance compensation, resettlement, worker housing, and procedures for implementing investment in industrial clusters;

+ Focal point to receive, resolve, coordinate, and request competent agencies to resolve procedures for implementing investment projects in industrial clusters (including: land acquisition, land lease, issuance of construction permits, approval of fire prevention and fighting plans, confirmation of environmental protection plans, or approval of environmental impact assessment reports) according to regulations and decentralization of the Provincial People's Committee and authorization of the District People's Committee;

+ Invest or propose competent authorities to decide on investment in technical infrastructure inside and outside the industrial cluster; Approve and implement plans to relocate businesses, production facilities, and industrial cluster development activities in the area;

+ Inspect and evaluate compliance with laws and policies on industrial clusters according to authority.

- Preside and advise the district People's Committee on developing and submitting for promulgation industrial promotion plans in accordance with legal regulations and local conditions; Advise competent authorities to ensure capital from the local budget to organize industrial promotion in the area.

- Advise and assist the District People's Committee in implementing state management of consumer protection according to the provisions of law.

- Organize the implementation of legal documents, planning, and plans after approval; information, propaganda, dissemination, and education of laws on industry and trade; and monitor the implementation of laws on industry and trade.

- Help the district-level People's Committee carry out and be responsible for the appraisal, registration, and issuance of licenses within the scope of responsibility and authority of specialized agencies according to the provisions of law and according to the assignment, decentralization, or authorization of the district-level People's Committee.

- Assist the District People's Committee in the state management of collective economic organizations, private economic organizations, associations, and non-governmental organizations operating in the area in the field of industry and trade according to the provisions of the law.

- Provide professional guidance on industry and trade for officials and civil servants of the commune-level People's Committee.

- Organize the application of scientific and technological advances; Build an information and storage system to serve state management and the professional expertise of the Economic Department or the Economic and Infrastructure Department.

- Carry out information work and periodic and irregular reports on the implementation of assigned tasks according to the regulations of the district People's Committee and the Department of Industry and Trade.

- Monitor and inspect organizations and individuals in implementing legal regulations on industry and trade; Receiving citizens, resolving complaints and denunciations; Prevent and combat corruption and waste according to the provisions of law and assignments of the district People's Committee.

- Manage organizational structure, job positions, civil servant payroll, civil servant rank structure, implement salary regimes, policies, remuneration, rewards, discipline, training and fostering on professional expertise for civil servants under the scope of management in accordance with the law and as assigned by the district-level People's Committee.

- Manage and take responsibility for finances and assigned assets according to the provisions of law and management decentralization of the district People's Committee.

- Perform other tasks assigned by the People's Committee, Chairman of the District People's Committee and according to the provisions of law.
