According to Clause 1, Article 9 of Circular 14/2020/TT-BCT, the Industry and Trade Inspector's Card (hereinafter referred to as the Card) is issued by the Minister of Industry and Trade to the person assigned to perform the specialized inspection task.
In which, the validity period of the Card is 5 years from the date of issue. (Clause 3, Article 9 of Circular 14/2020/TT-BCT)
The Card of Inspector of Industry and Trade is granted in the following two forms:
- Issuing a new Card: When the civil servant meets the conditions and is assigned by the head of the agency to perform the task of specialized inspection;
- Card re-issuance: If the Card expires; If the Card is lost due to objective reasons, if the Card is damaged due to a change in the Card number, if the name of the agency assigned to perform the specialized inspection function changes, or there is a new regulation of the competent authority, the re-issued card has the same expiry date and card number as the previously issued Card.
(Clause 4, Article 9 of Circular 14/2020/TT-BCT)
Clauses 1 and 2, Article 10 of Circular 14/2020/TT-BCT stipulate the application for the Card of Specialized Inspector of Industry and Trade as follows:
(1) Application for new issuance of the Card includes:
- A written request from the head of the agency to the Ministry of Industry and Trade, requesting the issuance of the Card;
- List of applications for new card issuance (Appendix No. 07);
- Photograph of civil servants wearing industry uniforms requested for the Card (02 photos of size 20mm x 30mm) taken within 6 months with full name and agency clearly written on the back of the photo and on the envelope containing the photo.
(2) The application for re-issuance of the Card includes:
- A written request from the head of the agency to the Ministry of Industry and Trade, requesting the re-issuance of the Card;
- List of requests for re-issuance of the Card (Appendix No. 07);
- Photo of civil servants wearing industry uniforms applying for the Card (02 photos of size 20mm x 30mm) taken within 6 months with their full name and agency clearly written on the back of the photo and on the envelope containing the photo.
Specifically, in Article 11 of Circular 14/2020/TT-BCT stipulating the use of the card of specialized inspectors of Industry and Trade as follows:
- Persons assigned to perform specialized inspection tasks may only use the Card in the course of performing specialized inspection tasks as prescribed by law.
- It is strictly forbidden to use the Card for personal purposes, use someone else's Card or lend it to others for use. In the event that a civil servant uses the Card in contravention of regulations, depending on the nature and seriousness of the violation, he/she will be handled in accordance with the law.
- The head of the specialized inspection team must have the Card during the inspection process.
The head of the agency assigned to perform the specialized inspection function shall issue a decision to temporarily suspend the use of the card for the person assigned to perform the specialized inspection task under his/her management and report it to the Ministry of Industry and Trade in one of the following cases: case:
(1) There is a violation of the law in inspection activities according to the provisions of the law without a decision on handling;
(2) Being temporarily suspended from work for disciplinary consideration;
(3) Being disciplined in the form of a reprimand or more;
(4) Being prosecuted or detained.
(Clause 1, Article 12 of Circular 14/2020/TT-BCT)
The head of the agency assigned to perform the specialized inspection function shall issue a decision on the revocation of the card of the person assigned to perform the task of specialized inspection, cut the corner of the card before submitting it, and report it to the Ministry of Industry and Trade in one of the following cases: case:
- Relocating to another agency or unit, retiring, or resigning; passing away while working;
- Being convicted by a legally effective criminal sentence or disciplined by one of the forms of salary downgrade, demotion, dismissal, or forced resignation;
- Loss of capacity for civil acts.
