On December 30, 2024, the Minister of Industry and Trade of Vietnam issued Circular 41/2024/TT-BCT stipulating the list and periodic rotation schedule for positions of officials and public employees directly interacting with and handling work in the local industry and trade sector.

List of positions in the industry and trade sector required for periodic rotation in Vietnam from February 21, 2025​

The list of positions in the industry and trade sector subject to periodic rotation in Vietnam is defined in Article 2 of Circular 41/2024/TT-BCT as follows:

- Issuance of various import-export and trade service related licenses, specifically:

+ Certificate of eligibility for merchants trading in LPG/LNG/CNG;

+ Certificate of eligibility for LPG retail stores in bottles;

+ Certificate of eligibility for motor fuel retail stores;

+ Certificate of eligibility for petroleum retail agencies;

+ Acceptance notice for petroleum business using small-scale petroleum dispensing equipment;

+ Wholesale alcohol license in the province or municipality under central government;

+ Retail alcohol license;

+ Wholesale tobacco product license;

+ Retail tobacco product license;

+ License for establishing representative offices of foreign merchants in Vietnam;

+ Business license, license for establishing retail outlets of foreign-invested economic organizations in Vietnam;

+ License for electricity distribution operation up to a voltage level of 35 kV locally;

+ License for retail electricity activity up to a voltage level of 0.4 kV locally.

- Issuance of licenses related to ensuring safety standards in production and business, specifically:

+ License for activities within the protection area of dam, hydropower reservoir;

+ Certificate of eligibility for explosive precursor production;

+ Certificate of eligibility for producing/trading/producing and trading conditional substances in the industrial field;

+ License for industrial explosive material usage;

+ Certificate of technical safety training for industrial explosive materials for persons related to industrial explosive material usage;

+ Certificate of technical safety training for explosive precursors for persons in charge of the warehouses where explosive precursors are stored;

+ Certificate of eligibility for food safety premises;

+ Certificate of eligibility for LPG bottling stations into bottles;

+ Certificate of eligibility for LPG bottling stations into tank trucks;

+ Certificate of eligibility for LPG/LNG/CNG bottling stations into transportation vehicles;

+ License for the production of hand-crafted alcoholic beverages for business purposes;

+ License for industrial alcohol production (scale under 3 million liters/year);

+ Electricity generation license for power plants with a capacity of under 3 MW located locally;

+ Notification confirming the announcement of products, goods group 2 compliant with corresponding technical standards. Notification of acceptance of compliance documentation for products, goods compliant with national technical standards.

Periodic rotation schedule for positions of officials and public employees in the industry and trade sector in Vietnam

- The periodic rotation period for positions of officials and public employees directly interacting and handling work as per the list above ranges from 3 to 5 years.

- The time to calculate the rotation period starts from the time there is a written document regarding the deployment, arrangement, or assignment of tasks by the competent authority according to cadre management decentralization.

Circular 41/2024/TT-BCT is effective from February 21, 2025.
