To require Courts to be proactive and speed up the settlement of bad debt disputes in Vietnam is the content specified in Directive 02/CT-CA dated 15/5/2023 on the implementation of Resolution 63/2022/QH15 issued by the Court promulgated by the Supreme People.
The Supreme People's Court requests the Chief Justices of the High People's Courts, the Chief Justices of the People's Courts of the provinces and centrally run cities, and the heads of units of the Supreme People's Court to perform the following tasks:
- Be active, proactive, and speed up the settlement of disputes about bad debts in accordance with the authority, order, and procedures prescribed by law. In case of any difficulties or problems, they shall promptly report them to the Supreme People's Court for answers.
- Organize the dissemination of all contents of Resolution 63/2022/QH15 to judges, verifiers, and court clerks under their management;
Thoroughly grasp the continued application of provisions of Resolution 42/2017/QH14 on piloting bad debt settlement of credit institutions and Resolution 03/2018/NQ-HDTP guiding the application of a number of provisions of law in the settlement of disputes over the handling of bad debts and collaterals of bad debts at the People's Courts.
- Actively and regularly update the system of legal documents to properly apply regulations and instructions in the course of performing tasks.
In addition, the Supreme People's Court also requires the Chief Justices of the High People's Courts, the Chief Justices of the People's Courts of the provinces and centrally run cities, and the heads of units under the Supreme People's Court, after receiving Directive 02/CT-CA dated May 15, 2023, to implement:
Notify judges, verifiers, court clerks in their agencies and units, and the People's Courts of districts, towns, and cities within their territorial jurisdiction for information and implementation.
