Responsibilities of the carrier of dangerous goods in Vietnam

On March 31, 2024, the Government of Vietnam issued Decree 34/2024/ND-CP stipulating the List of Dangerous Goods, the transportation of dangerous goods by road motor vehicles and inland waterway vessels, including regulations on the responsibilities of dangerous goods carriers.

Responsibilities of the carrier of dangerous goods in Vietnam

Decree 34/2024/ND-CP stipulates the responsibilities for the carrier of dangerous goods:

- Arrange appropriate transportation means for the type of dangerous goods to be transported.

- Inspect the goods to ensure safety before embarking on transportation as regulated.

- Fully comply with notifications from the transport hirer and the provisions stated in the Dangerous Goods Transportation Permit.

- Display the dangerous symbols of the type, group of dangerous goods being transported as regulated.

- Clean and remove or obliterate the dangerous symbols on the transportation means after unloading all goods if not continuing to transport that type of goods.

- Comply with the provisions stated in the Permit and only organize the transport of dangerous goods when having a valid Dangerous Goods Transportation Permit for the type, group, name of goods that are regulated to have a Permit, and have dangerous symbols and signals.

- Only transport dangerous goods when the goods have complete and valid documentation and safe packaging for transportation.

- Follow the guidance of the direct managing unit or construction unit when transporting dangerous goods that are flammable, spontaneously combustible, liquid or solid explosive materials through particularly important bridge or tunnel constructions shorter than 100m or other constructions under high temperature work, welding fire, electric sparks on the transport route.

- Have an emergency oil spill response plan when transporting gasoline and oil on inland waterways.

- Organize training or hire units with the function of dangerous goods safety training for vehicle operators as regulated in Article 8 of Decree 34/2024/ND-CP.

Decree 34/2024/ND-CP takes effect from May 15, 2024.
