Duties and authority of the Ministry of Foreign Affairs of Vietnam regarding national borders and territory

On February 24, 2025, the Government of Vietnam issued Decree 28/2025/ND-CP stipulating the functions, tasks, powers, and organizational structure of the Ministry of Foreign Affairs.

Duties and authority of the Ministry of Foreign Affairs of Vietnam regarding national borders and territory

In terms of duties related to national borders and territory, the Ministry of Foreign Affairs shall take the lead, in cooperation with ministries, ministerial-level agencies, related agencies, and localities as per regulations:

- Propose guidelines, policies, strategies, measures, and conduct research, aggregate, and assess the situation of national borders and territory on land, islands, airspace, and maritime areas of Vietnam; resolve legal disputes concerning borders and territory; engage in political, diplomatic, legal struggles, public opinion to protect the borders, territorial integrity, sovereignty, sovereign rights, and national jurisdiction of Vietnam on land, islands, airspace, and maritime areas;

- Advise and propose the determination of national borders, scope of sovereignty, sovereign rights, and national jurisdiction on land, islands, airspace, and maritime areas of Vietnam;

- Advise, propose, and organize negotiations for defining national borders and territory; determine the boundaries of airspace and maritime areas of Vietnam with neighboring countries; sign, cooperate and organize the implementation of international treaties related to national borders and territory with concerned countries; request ministries, ministerial-level agencies, and related agencies and localities to report periodically or unexpectedly on the management and protection of borders;

- Advise and propose the development and implementation of guidelines, policies, strategies, planning for developing the system of land border gates nationwide; advise the Government of Vietnam on policies for opening and upgrading land border gates and measures needed to ensure the stability and clarity of border lines and national borders; build a national database on border territory.

Decree 28/2025/ND-CP shall take effect on March 1, 2025.
