On May 11, 2024, the Ministry of Transport issued Decision 421/QD-BGTVT on the announcement of newly issued transport-related administrative procedures under the Ministry of Transport.
(1) Procedures
*Submit application:
The individual that uses a land motor vehicle or an inland watercraft to transport dangerous goods (hereafter referred to as "carrier") shall submit their applications to the authority responsible for granting licenses to transport dangerous goods, specifically:
- Ministry of Public Security has the power to issue transport licenses for dangerous goods of class 1, class 2, class 3, class 4 and class 9 classified according to Clause 1 of Article 4 of Decree 30/2024/TT-BGTVT (excluding crop protection chemicals and organizations, enterprises under the management of the Ministry of National Defense).
- The Ministry of National Defense shall grant licenses to transport dangerous goods for organizations and enterprises under its management.
- Ministry of Science and Technology has the power to issue transport licenses for dangerous goods of class 5 and class 8 classified according to Clause 1 of Article 4 of Decree 30/2024/TT-BGTVT.
- The People's Committees of provinces, centrally-run cities shall grant licenses to transport dangerous goods for plant protection chemicals.
* Proceed with administrative procedures
- In the case of direct submission of applications: the administrative procedure authority shall check the document composition and provide an immediate response when the organization or individual submits the application. In case the document is incomplete or contains discrepancies, guidance shall be provided for completing the document according to regulations.
- In the case of submission of applications via postal services or online public service systems: within a period not exceeding 01 working day from the date of receiving the application, the administrative procedure authority shall examine the completeness of the document. If the document is incomplete according to regulations, the administrative procedure authority shall notify the organization or individual in writing or through the online public service system to supplement the document and provide guidance for completion according to regulations.
Regarding the procedure for granting licenses to transport dangerous goods of class 7, it shall be implemented according to regulations on radiation work and atomic energy application support activities.
- Within a period of 05 working days from the date of receiving the complete and compliant documents as regulated, the licensing authority shall issue the License to Evaluate the Documents for granting licenses to transport dangerous goods. In case the license is not granted, the licensing authority shall provide a written response or notify via the online public service system, stating the reason.
(2) Documents:
The application for granting licenses to transport dangerous goods of class 5 and 8 shall include:
- Application form for granting licenses to transport dangerous goods according to the prescribed form.
- Copy, electronic copy, or original copy of the list of vehicles participating in transportation, ensuring the validity of inspections as regulated.
- Copy or electronic copy or original copy of the list of drivers of dangerous goods transportation (including: Full name; ID card number or citizen identification number or passport number; license number, license class (for drivers); certificate number of professional competence, class (for sailors)) and the list of loaders in cases where loaders are mandatory (including: full name, ID card number, citizen identification number, or passport number) accompanied by a copy of the certificate of completion of the safety training program.
- Copy, electronic copy, or original copy of the transportation organization plan, dangerous goods of the transport unit according to the prescribed template (including at least the following contents: vehicle control sign; name of the driver; type of goods; weight; route, transportation time; measures for handling chemical incidents in the transportation of dangerous goods).
- Copy or electronic copy of the certificate of completion of the safety training program for drivers of road motor vehicles for the transportation of dangerous goods by road motor vehicles; copy or electronic copy of the special professional certificate of crew members for the transportation of dangerous goods on inland waterways.
* The application for granting licenses to transport dangerous goods of types 1, 2, 3, 4, and 9 includes:
- Application form for granting licenses to transport dangerous goods according to the prescribed form.
- Copy, electronic copy, or original copy of the list of vehicles participating in transportation, ensuring the validity of inspections as regulated.
- Copy or electronic copy or original copy of the list of drivers of dangerous goods transportation (including: full name; ID card number or citizen identification number or passport number; license number, license class (for drivers); certificate number of professional competence, class (for sailors)) and the list of loaders in cases where loaders are mandatory (including: full name, ID card number, citizen identification number, or passport number), accompanied by a copy of the certificate of completion of the safety training program.
- Copy, electronic copy, or original copy of the transportation organization plan, dangerous goods of the transport unit according to the prescribed template (including at least the following contents: vehicle control sign; name of the driver; type of goods; weight; route, transportation time; measures for handling chemical incidents in the transportation of dangerous goods).
- Copy or electronic copy of the certificate of completion of the safety training program for drivers of road motor vehicles for the transportation of dangerous goods by road motor vehicles; copy or electronic copy of the special professional certificate of crew members for the transportation of dangerous goods on inland waterways.
- Copy, electronic copy, or original copy of the oil spill response plan (applicable only to the transportation of petroleum products on inland waterways).
* The application for granting licenses to transport dangerous goods of plant protection chemicals includes:
- Application form for granting licenses to transport dangerous goods according to the prescribed template.
- Copy, electronic copy, or original copy of the list of vehicles participating in transportation, ensuring the validity of inspections as regulated.
- Copy or electronic copy or original copy of the list of drivers of dangerous goods transportation (including: full name; ID card number or citizen identification number or passport number; license number, license class (for drivers); certificate number of professional competence, class (for sailors)) and the list of loaders in cases where loaders are mandatory (including: full name, ID card number, citizen identification number, or passport number), accompanied by a copy of the certificate of completion of the safety training program.
- Copy, electronic copy, or original copy of one of the following documents: Supply contract; Financial invoice for the export or import of plant protection chemicals.
- Copy, electronic copy, or original copy of the transportation organization plan, dangerous goods of the transport unit according to the prescribed template (including at least the following contents: vehicle control sign; name of the driver; type of goods; weight; route, and transportation time).
- Copy or electronic copy of the certificate of completion of the safety training program for drivers of road motor vehicles for the transportation of dangerous goods by road motor vehicles; copy or electronic copy of the special professional certificate of crew members for the transportation of dangerous goods on inland waterways.
