The Minister of Justice of Vietnam promulgates Circular 01/2025/TT-BTP dated February 21, 2025, amending Circular 21/2011/TT-BTP on the management of foreign adoption agencies in Vietnam, which had been amended by Circular 11/2021/TT-BTP.
Circular 01/2025/TT-BTP has amended and supplemented Clause 1, Article 2 of Circular 21/2011/TT-BTP on foreign adoption agencies licensed to operate in Vietnam as follows:
According to the regulations in Article 37 of Decree 19/2011/ND-CP, based on the number and needs of Vietnamese children requiring overseas adoptive families, the conditions and capabilities of foreign adoption organizations desiring to operate in Vietnam, and following consultations with the Central Authorities on international adoption of the relevant foreign countries, the Ministry of Justice shall preside and cooperate with the Ministry of Foreign Affairs and the Ministry of Public Security to determine the number of foreign adoption agencies licensed to operate in Vietnam (hereinafter referred to as "foreign adoption organizations").
Meanwhile, the current regulation in Clause 1, Article 2 of Circular 21/2011/TT-BTP stipulates that pursuant to Article 37 of Decree 19/2011/ND-CP, based on the number and needs of Vietnamese children requiring overseas adoptive families, the conditions and capabilities of foreign adoption organizations desiring to operate in Vietnam, and after consultations with the Central Authorities on international adoption of the relevant foreign countries, annually, the Adoption Department shall cooperate with the functional units of the Ministry of Foreign Affairs and the Ministry of Public Security to assess, report to the Minister of Justice to specify the number of foreign adoption organizations licensed to operate in Vietnam (hereinafter referred to as "foreign adoption organizations").
Circular 01/2025/TT-BTP takes effect on April 8, 2025.
