Fee rates for exploiting and using national remote sensing data in Vietnam from August 1, 2023

On June 9, 2023, the Minister of Finance issued Circular 39/2023/TT-BTC providing for rates, collection, transfer, exemption, management and use of fees for exploiting and using national remote sensing data in Vietnam.

Fee rates for exploiting and using national remote sensing data in Vietnam from August 1, 2023

The fee rates and fee exemption for exploiting and using national remote sensing data in Vietnam according to Circular 39/2023/TT-BTC are as follows:

- Rates of fees for exploiting and using national remote sensing data are specified in the Fee Schedule enclosed with Circular 39/2023/TT-BTC.

If the data provided is too old (36 months or more) before the date of its provision, the fee rates are 50% of the corresponding fee rates specified in the Fee Schedule enclosed with Circular 39/2023/TT-BTC.

- The rates of fees for exploiting and using national remote sensing data for national defense and security purposes or in the event of emergency are 60% of the corresponding fee rates specified in clause 1 of Article 4 of Circular 39/2023/TT-BTC.

- The national remote sensing data shall be provided free of charge as requested by leaders of the Communist Party and of the State.

Guidance on declaration and payment for exploiting and using national remote sensing data in Vietnam

Guidance on declaration and payment for exploiting and using national remote sensing data in Vietnam is as follows:

-  Fee payers shall pay the fees according to the rates mentioned in Article 3 of Circular 39/2023/TT-BTC to the collecting organizations using the methods specified in Circular 74/2022/TT-BTC on methods, deadlines for collection, transfer and declaration of fees and charges under the jurisdiction of the Ministry of Finance.

- No later than the 05th of each month, collecting organizations shall transfer the fees that were collected in the previous month to their accounts designated for amounts pending transfer to state budget opened at State Treasury.

Collecting organizations shall declare, collect, transfer and finalize fees in accordance with Circular 74/2022/TT-BTC (fees collected by central authorities shall be transferred to the central government budget; fees collected by local authorities shall be transferred to local government budgets).
