On December 15, 2023, the Minister of Agriculture and Rural Development of Vietnam issued Circular 22/2023/TT-BNNPTNT amending Circulars in the field of forestry, in which amends regulations on cases of approval of plans for exploiting common forest plants in Vietnam.
Starting on February 1, 2024, the cases for approving regular forest plant exploitation plans include:
(1) Exploitation of timber from natural forests of common forest plants;
(2) Harvesting timber from natural forests of common forest plants;
(3) Exploitation of non-timber forest plants from special-use forests;
(4) Collection of forest plant samples for scientific and technological research from special-use forests;
(5) Main exploitation, utilization, and harvesting of timber from production forests that are planted by the state as the owner's representative;
(6) Main exploitation, utilization, and harvesting of timber from protected forests that are planted;
(7) Utilization and harvesting of timber from planted special-use forests, except for cases where exploitation is carried out to fulfill the tasks of authorized scientific and technological research programs and projects.
The approval of regular forest plant exploitation plans will be carried out by the following agencies:
- The ministries and sectors in charge will approve exploitation, utilization, harvesting, and sample collection plans for cases specified in (1), (2), (3), (4), and (7) on forest areas managed by subordinate units.
- The authorized agency approving forest planting funds will approve exploitation plans for cases specified in (5).
- The district-level People's Committee will approve exploitation plans for cases specified in (6) carried out by individuals, households, or communities with self-investment or according to projects and support policies of the state; utilization and harvesting of timber from natural production forests managed by individuals, households, or communities.
- The Department of Agriculture and Rural Development will approve exploitation plans for cases not specified in (1), (2), or (3).
