On October 31, 2024, the Ministry of Justice of Vietnam issued Official Dispatch 6287/BTP-KHTC regarding the implementation of the Regulation on developing the plan of the Ministry of Justice of Vietnam.
On October 28, 2024, the Minister of Justice of Vietnam signed Decision 2026/QD-BTP to promulgate the Regulation on developing the plan of the Ministry of Justice, replacing Decision 678/QD-BTP dated March 26, 2019, on the promulgation of the Ministry's Regulation on developing the plan.
The regulations take effect from October 28, 2024, introducing several fundamental new points, concretizing guidelines, simplifying internal administrative procedures, enhancing the responsibility of heads of units in planning work, particularly ensuring the connection between work plans and implementation funding...
To promptly and effectively implement the regulations, the Ministry requests heads of units to:
(1) Organize the dissemination and thorough understanding of the regulations' content to all officials and public employees, workers within the unit for consistent and rigorous implementation, with attention to the following fundamental new contents:
- Regarding the role and responsibility of the units: Emphasizes proactive engagement, accountability under the law, and the Ministry's leadership in advising on planning, and developing the content of the plans created by the unit.
- Regarding the time for planning, submitting for issuance or approval
+ For the annual work plans of units, they must be submitted to the Ministry's leadership by no later than December 15 of the year preceding the plan year. The Ministry's leadership must approve the plan by no later than December 31 of the year preceding the plan year.
+ For the Ministry's specialized plans:
Regarding the Ministry's annual specialized work plans with no legal provisions or guidelines from the specialized management agency on timing for planning and issuing: the draft plans are to be submitted to the Ministry's leadership by no later than December 15 of the year preceding the plan year. The Ministry’s leadership must issue the plan by no later than December 31 of the year preceding the plan year;
For the Ministry's annual specialized work plans with legal provisions or guidelines from the specialized management agency on timing for planning and issuing: the unit planning the plan must proactively balance the time to submit the draft, ensuring there’s enough time for the Ministry's leadership to consider and issue the plan within the legal time limits or those set by the specialized management agency.
For long-term or emergency Ministry’s specialized work plans: the unit planning the plan must proactively balance the time to submit the draft, ensuring there’s enough time for the Ministry's leadership to consider and promptly issue the plan to meet task deployment requirements.
- Regarding the planning process
The regulations have simplified the process, reducing it from four steps to three (removing the verification step), and reducing the response time for written feedback from Ministry units from 05 days to 03 working days.
For the planning process of units with self-managed regular expenditures: The regulations specify no difference from other Ministry units.
- Regarding adjustments to the work plan: The regulations stipulate that only in cases where plan adjustments lead to changes in budget funding allocation does the head of the unit need to create a new plan, which must be discussed and agreed with the Planning and Finance Department before reporting to the Ministry leadership.
(2) During the implementation of the regulations, if difficulties or obstacles arise, units are requested to send written inquiries to the Ministry (Planning and Finance Department) for prompt guidance.
