The Government of Vietnam issued Decree 11/2025/ND-CP providing guidance on the Geology and Minerals Law regarding the exploitation of group IV minerals, which includes provisions on the duration of licenses for the exploitation of group IV minerals.
This Decree provides detailed regulations on the duration of mineral exploitation licenses for group IV minerals; the extension, adjustment, return, revocation, and termination of the validity of group IV mineral exploitation licenses; the appraisal agency, the documents, procedures, and process for granting, extending, adjusting, returning, and revoking group IV mineral exploitation licenses; environmental protection, rehabilitation, and restoration in group IV mineral exploitation; and the handling of excess minerals as stipulated in point d, clause 2, Article 73 of the Law on Geology and Minerals.
- The group IV mineral exploitation license (hereafter referred to as the exploitation license) issued to organizations or individuals stipulated in clause 1, Article 72 of the Law on Geology and Minerals has a maximum duration not exceeding 10 years, including the time for basic construction and exploitation as determined by the mineral exploitation investment project. The duration of the exploitation license may be extended multiple times as stipulated in Article 7 of Decree 11/2025, but the total extension period shall not exceed 5 years.
- The exploitation license issued to organizations stipulated in clause 2, Article 72 of the Law on Geology and Minerals has a maximum duration equal to the project's execution period, including basic construction time and exploitation time, as noted in the exploitation license.
The duration of the exploitation license may be extended multiple times as stipulated in Article 7 of Decree 11/2025, but the total duration of issuance and extension shall not exceed the execution period (including the period to be extended or adjusted) of the project using minerals as stated in the exploitation license.
Decree 11/2025/ND-CP is effective from January 15, 2025.
(According to the Law on Geology and Minerals, based on utility and management purposes, minerals are classified into groups I, II, III, and IV, in which group IV minerals include those only suitable for purposes such as embankment materials, foundation filling, construction of hydraulic works, and disaster prevention, including: clay, loam, and other similar named earth; mixed soil and rocks, sand, gravel, or pebbles; sand (excluding riverbed, lakebed, and marine area sand and gravel)).
