Currently, the regulations regarding the promotion of public employees are quite complex, especially for public employees who are teachers. Therefore, Decree 115/2020/ND-CP (effective September 29, 2020) has provided guidance on 05 noteworthy aspects of the promotion of public employees as follows:

1. Classification of professional titles of public employees as teachers in Vietnam

According to the provisions of Article 28 Decree 115/2020/ND-CP, based on the complexity of the work of the professional title, the professional titles of public employees in the same career field are ranked from high to low as follows:

- Professional title rank I;

- Professional title rank II;

- Professional title rank III;

- Professional title rank IV;

- Professional title rank V.

According to the provisions of Joint Circular 20/2015/TTLT-BGDDT-BNV; Joint Circular 21/2015/TTLT-BGDDT-BNV; Joint Circular 22/2015/TTLT-BGDDT-BNV; Joint Circular 23/2015/TTLT-BGDDT-BNV, the professional titles of public employees as teachers are classified according to different educational levels as follows:

- Preschool teachers: Preschool teacher rank II (Code: V.07.02.04); Preschool teacher rank III (Code: V.07.02.05); Preschool teacher rank IV (Code: V.07.02.06).

- Primary school teachers: Primary school teacher rank II (Code: V.07.03.07); Primary school teacher rank III (Code: V.07.03.08); Primary school teacher rank IV (Code: V.07.03.09).

- Lower  secondary school teachers: Lower secondary school teacher rank I (Code: V.07.04.10); Lower secondary school teacher rank II (Code: V.07.04.11); Lower secondary school teacher rank III (Code: V.07.04.12).

- Upper secondary school teachers: Upper secondary school teacher rank I (Code: V.07.04.13); Upper secondary school teacher rank II (Code: V.07.04.14); Upper secondary school teacher rank III (Code: V.07.04.15).

2. Standards and conditions for registering for exams or considering promotions of public employees as teachers in Vietnam

Based on Article 32 Decree 115/2020/ND-CP and Article 3 Circular 28/2017/TT-BGDDT, the standards and conditions for registering for exams or considering promotions of public employees as teachers are stipulated as follows:

- Possessing the capacity and professional qualifications to take on a higher-ranking professional title immediately adjacent to the current professional title in the same field of expertise;

- Meeting the requirements for diplomas, certificates, and other criteria for the professional title being contested or considered for promotion (Note: In cases where public employees are exempt from foreign language and computer science exams as regulated, they must meet the criteria for foreign language and computer science standards of the professional title being contested or considered for promotion);

- Meeting the minimum service period requirement for holding the immediately lower-ranking professional title according to the standards of the professional title being contested or considered for promotion;

- The educational institution has a need for the job position of the professional title at the rank registered for consideration and is nominated by the competent authority to participate in the promotion consideration process;

- Being evaluated by the competent authority as having completed good tasks or higher during the 3 continuous years of service up to the deadline for submitting the promotion consideration application; possessing sufficient professional ethics and character; not currently under disciplinary action or having a notice of disciplinary consideration by a competent authority.

3. Dossiers for registering for exams or considering promotions of public employees as teachers in Vietnam

According to the provisions of Article 36 Decree 115/2020/ND-CP, the dossiers for registering for exams or considering promotions of professional titles include:

- The curriculum vitae of the public employee (prepared no later than 30 days before the final deadline for submitting the registration dossier for the exam or considering the promotion of public employees) and certified by the employing agency or unit;

- The evaluation and assessment sheet of the head of the public service provider employing the public employee as a teacher or the head of the competent authority managing the public service provider concerning the standards and conditions for registering for exams or considering promotions of public employees according to the regulations;

- Copies of diplomas and certificates as required by the professional title being contested or considered for promotion;

- Other requirements as prescribed by the standards of the professional title being contested or considered for promotion.

4. Form, content, and time of the promotion exam for public employees as teachers in Vietnam

Based on Article 39 Decree 115/2020/ND-CP, the form, content, and time of the promotion exam for public employees as teachers are as follows:

General knowledge subject:

- Exam form: Multiple-choice;

- Exam content: 60 questions about the policy, guidelines of the Communist Party, legal policies concerning sectors and fields of career, laws on public employees according to the requirements of the professional title being contested;

- Exam duration: 60 minutes.

Foreign language subject:

- Exam form: Multiple-choice;

- Exam content: 30 questions in one of the following languages: English, Russian, French, German, Chinese, as per the requirements of the professional title being contested determined by the head of the agency or unit with authority to organize the promotion exam for professional titles;

- Exam duration: 30 minutes.

Computer science subject:

- Exam form: Multiple-choice;

- Exam content: 30 questions per the requirements of the professional title being contested;

- Exam duration: 30 minutes.

Professional specialty subject:

- For the promotion exam to professional title rank I: Thesis writing, 8 hours, and thesis defense, maximum 30 minutes, as required by the professional title being contested. The thesis writing and thesis defense are scored on a scale of 100 each;- For the promotion exam to professional title rank II: Written exam, 180 minutes as required by the professional title being contested, scored on a scale of 100;- For the promotion exam to professional title ranks III and IV: Written exam, 120 minutes as required by the professional title being contested, scored on a scale of 100.

Note: Foreign language exam exemption for the promotion exam of public employees as teachers in the following cases:

- Employees with less than 5 years of service until the retirement age month;- Holders of ethnic minority language certificates or ethnic minority people working in ethnic minority areas;- Graduates of foreign language majors at the undergraduate or postgraduate level or holders of a degree in foreign language majors at the same level of training as prescribed in the standards of the professional title being contested;- Graduates of undergraduate, postgraduate, or equivalent degrees as required in the training level relative to professional skills according to the standards of the professional title being contested received from abroad or in a foreign language medium in Vietnam, recognized by the competent authority;

Exemption from computer science exams for public employees as teachers with a graduation diploma from intermediate level or higher in relevant computer science, information technology disciplines.

5. Determining selected candidates in the promotion exam for public employees as teachers in Vietnam

- Having at least 50% correct answers in each subject of general knowledge, foreign language, and computer science exams;

- Having a total result score of the professional specialty subject of 50 points or higher, in cases of promotion to professional title rank I, achieving 100 points or higher (in which each thesis writing exam and thesis defense exam must achieve 50 points or higher) and ranked in descending order within the limit of the promotion quota for the professional title assigned.

- In cases where 2 or more candidates have the same total score in the professional specialty subject in the final quota for the promotion of public employees, the selection is prioritized in the following order: Female public employees; ethnic minority public employees; older public employees (by day, month, and year of birth); public employees with more years of service.
