On June 01, 2020, the Ministry of Public Security submitted the Draft Law on ensuring road traffic order and safety to the National Assembly of Vietnam for consideration. This Draft Law has stipulated conditions of drivers participating in traffic.
Specifically, according to the Draft Law on ensuring road traffic order and safety of Vietnam, drivers when participating in road traffic must meet the following conditions:
- Drivers of vehicles to join in traffic must be of the age and in good health as prescribed below, and proper driver licenses for the types of vehicle they are permitted to operate, which are granted by competent state agencies.
+ Persons aged full 16 years or older may drive mopeds with a cylinder capacity of under 50 cm3, electric motorcycles;
+ Persons aged full 18 years or older may drive motorcycles, three-wheeled motor vehicles with a cylinder capacity of 50 cm3 or higher and vehicles with similar structure; trucks, tractors with a mass of under 3,500 kg; passenger cars of up to 9 seats and special-use vehicles;
+ Persons aged full 21 years or older may drive trucks, tractors with a mass of 3,500 kg or more; category-B2 vehicles pulling trailers (FB2);
+ Persons aged full 24 years or older may drive passenger cars of between 10 and 30 seals; category-C vehicles pulling trailers or semi-trailers (FC);
+ Persons aged full 27 years or older may drive passenger cars of over 30 seals; category-D vehicles pulling trailers (FD);
+ The maximum age of drivers of 30 seat-plus passenger cars is in accordance with the Labor Code of Vietnam.
- Learner drivers, when joining in traffic, shall practice driving on driving practice vehicles and have their driving supported by driving instructors as prescribed by law.
- Candidates for the driving test when participating in traffic must take the test on the test vehicle, on the test route and have the driver sponsor the driver in accordance with the law.
- Operators of special-use vehicles joining in traffic must reach eligible age and physically fit for their occupations, and possess a certificate for operating special-use vehicles, granted by a special-use vehicle operator training establishment and a car driving license or a certificate of training in the law on road traffic order and safety. Operators of special-use vehicles with wheeled cranes must have a category-C driving license.
