On June 04, 2024, the Minister of Natural Resources and Environment of Vietnam issued Decision No. 1524/QD-BTNMT to announce the administrative procedures that have been amended and supplemented in the field of marine and island management within the scope of state management functions of the Ministry of Natural Resources and Environment.

Procedures for exploiting and using the database of marine and island resources and environment through electronic networks at central level in Vietnam

(1) Order of Execution

- Step 1: Submit Dossier:

Organizations or individuals wishing to exploit and use the marine and island resource and environment database shall submit an online dossier on the Administrative Procedures Settlement Information System of the Ministry of Natural Resources and Environment at the address: http://dichvucong.monre.gov.vn.

- Step 2: Dossier Review:

The database management agency is responsible for reviewing the request to exploit and use the database by organizations or individuals. The dossier processing officer must check the accuracy of the dossier components and documents to ensure that the dossier is complete and valid as prescribed by law.

In case the dossier request is incomplete, the database management agency is responsible for sending feedback information to the organization or individual with guidance on supplementary information. The notification and guidance shall be performed through appropriate forms, such as by email, or through the message sending function to citizens of the Administrative Procedures Settlement Information System.

- Step 3: Notification and Dossier Result Return:

For online submitted dossiers, the system will update the supplementary dossier submission status and the dossier will be transferred to the database management agency on the Administrative Procedures Settlement Information System.

+ In case the dossier is complete and accurate as per regulations: with valid request information, the database management agency shall provide the data to the organization or individual:

(i) The dossier processing officer checks and reviews the data catalog requested by the organization or individual for exploitation and usage to determine if it is part of the marine and island resource and environment database as prescribed in Circular No. 294/2016/TT-BTC and verifies whether the information in the database inventory of the management agency is sufficient. Cross-check to determine if the requested marine and island resource and environment data is included in the list of confidential information under Decision No. 1660/QD-TTg of 2020 by the Prime Minister regarding the issuance of the state secrets list in the field of resources and environment;

(ii) The dossier processing officer calculates the data exploitation fee and sends a fee notice to the organization or individual exploiting the data on the Administrative Procedures Settlement Information System. The fee notice must clearly state the payment time, location, and the amount that the organization or individual has to pay;

(iii) After the Administrative Procedures Settlement Information System displays the "fee paid" status for online payment cases, the dossier processing officer transfers a Data Copy and transfer receipt to the One-Stop Office’s dossier reception officer at least one working day before the scheduled result return time to the organization or individual;

(iv) In case the organization or individual does not continue to exploit the data, the system automatically ends the dossier processing procedure.

+ In case of refusal to provide data, the database management agency must send a notice clearly stating the reason to the organization or individual.

(2) Dossier Components: requests must be sent via email to the data management agency with the following details:

- Name and address of the organization; full name, residence, contact address, ID card number or Citizen Identity card number or personal identification number or passport number of the individual; fax number, telephone number, email address (if any) of the organization or individual;

- List and content of data to be provided;

- Purpose of data exploitation and usage;

- Methods of data exploitation and usage, and method of receiving results.

(1) Order of Execution

- Step 1: Submit Dossier:

Organizations or individuals wishing to exploit and use the marine and island resource and environment database shall submit an online dossier on the Provincial-level Administrative Procedures Settlement Information System.

- Step 2: Dossier Review:

The database management agency is responsible for reviewing the request to exploit and use the database by organizations or individuals. If the dossier information request is incomplete, the database management agency is responsible for sending feedback information to the organization or individual with guidance on supplementary information.

- Step 3: Notification and Dossier Result Return:

For online submitted dossiers, the system will update the supplementary dossier submission status and the dossier will be transferred to the database management agency on the Administrative Procedures Settlement Information System.

+ In case the dossier information request is valid, the database management agency shall provide the data to the organization or individual;

+ In case of refusal to provide data, the database management agency must send a notice clearly stating the reason to the organization or individual.
