From January 20, 2021, the Circular No. 6/2020/TT-BNV on Organizational Regulations; Regulations on recruitment and selection examination for officials and public employees, examination for promotion of officials rank, examination or consideration for promotion of professional titles of public employees, issued by the Ministry of Home Affairs of Vietnam on December 02, 2020, will officially take effect. How are the forms of handling violations when recruiting officials and public employees regulated?

According to Article 2 of the Regulations issued together with the Circular No. 6/2020/TT-BNV of the Ministry of Home Affairs of Vietnam, the handling of violations against candidates participating in the entrance exam, recruitment examination for officials and public employees, examination for promotion of officials rank, examination or consideration for promotion of public employee professional titles are specified as follows:

- Intentionally sitting the wrong seat where his/her registration number is written;
- Discussing with other candidates and have been warned but still do not comply;
- Bringing into the exam room cell phones, recorders, cameras, computers, other technical means of receiving and transmitting information, data backup means, storage and transmission equipment and other information and papers and documents related to the exam content (unless otherwise specified in the exam questions).

Warning
|
- Exchanging work or scratch paper with other candidates;
- Allowing another candidate to copy or copy another candidate's work;
- Using documents, cell phones, recorders, cameras, computers, other technical means of receiving and transmitting information, data backup means, storage and transmission equipment and other information in the exam room (unless otherwise specified in the exam questions).

Suspension of exams
|
- Violators have been recorded in the form of a warning but still intentionally violate the exam rules;
- Candidates intentionally cause unsafety and disorder affecting the exam room.

The head of the examination board shall decide to suspend the examination and publicly announce it at the examination room
|

Cancel exam results
|
- Write and draw on the exam paper the content that is not related to the content of the test;
- Swapping the exam or taking the exam on behalf of another person or being suspended from the exam.
|
Heads of competent agencies and units shall organize recruitment of officials, public employees promotion exams, and promotion of public employee professional titles based on the report of the Chairman of the Council.
|
|
Subtract test scores
|
- Candidates who are reprimanded in any test, exam or subject will be deducted 25% of the total number of correct answers or 25% of the total score of that section or exam;
- Candidates who are warned in any test, exam or subject will be deducted 50% of the total number of correct answers or 50% of the total score of that section or exam.
|
The Secretary of the Council shall report to the Chairman of the Council to consider and decide on the deduction of points when matching beats and make points based on the minutes of violation handling made by the examination room superintendent.

|
For the paper-based or written multiple-choice test:
- The exam or subject has two or more assignments;
- An exam or subject has two or more different characters;
- The exam or subject is written in two or more different ink colors or written in incorrect ink color, except for the case where there is a written confirmation of the examiner at the examination room and the head of the examination committee;
- Exams and subjects are written on scratch paper, paper that is not distributed by the test room's proctor.

The head of the examination committee decides to score zero (0) based on the written report of the judging member

Note:
- Candidates who violate the rules and regulations must be recorded in writing, and the examiner of the examination room and the violating candidate must both sign the minutes. After making the minutes and publicly announcing it in the examination room, the examination room supervisor must immediately report to the head of the examination board.
- In case the violating candidate does not sign the violation record, the examiner of the examination room invites 02 candidates next to him to sign to confirm the incident. In case one of the two candidates or both candidates are invited to sign to confirm the fact that they do not sign the minutes, the examiner of the examination room still makes a record and reports it to the head of the examination committee for consideration and decision.
- Candidates who intentionally cause unsafety and disorderly conduct affecting the examination room, in addition to being suspended or canceled exam results, depending on the nature and severity of their tests, will also be handled according to the provisions of criminal law.
- Contestants who are officials or public employees, if the exam is suspended or all results are canceled, heads of agencies or units with management competence shall consider and handle disciplinary actions in accordance with the law on officials and public employees.
