Regarding this issue, LawNet would like to answer as follows:
Cases in which information and documents can be searched and exploited in the citizen identity archives according to Clause 2, Article 12 of Circular 10/2016/TT-BCA are as follows:
+ When a citizen apply for issuance, reissue or replaces his or her citizen identity card.
+ When there is a request to look up and verify information on citizen identification of agencies, organizations, and individuals in accordance with law and the Ministry of Public Security.
Procedures for searching and exploiting information and documents in the citizen identity archives according to Clause 3, Article 12 of Circular 10/2016/TT-BCA are as follows:
* For agencies and organizations:
- The document (signed and stamped by the leader) of the agency or organization requesting the search and exploitation, clearly stating the purposes and contents to be searched and exploited;
- Letter of introduction of the agency or organization;
- Present your citizen's identity card (people's identity card) or people's police identity card.
* For individuals:
- An application form (certified by the People's Committee of the commune, ward, or township where he/she permanently resides or the agency or organization where he/she works), clearly stating the purposes and contents to be searched and exploited;
- Papers related to the proposed content (if any);
- Present your citizen's identity card (people's identity card) or people's police identity card.
Time to respond to requests for searching and exploiting information and documents in the citizen identification archives according to Article 14 of Circular 10/2016/TT-BCA (amended in Circular 39/2019/TT-BCA) as follows:
(1) In case of a request to look up and exploit information and documents to serve the issue, change or re-issue of citizen identity cards or people's identity cards, the time limit for the citizen identification archive management agency to search and reply to the results is prescribed as follows:
* For the search for the issuance, exchange, and reissue of citizen identification cards:
- If the search requesting agency is located in a district, city, or town, it shall not exceed 1.5 working days from the date of receipt of the request;
- If the search requesting agency is located in mountainous, highland, border, or island districts, it shall not exceed 05 working days from the date of receipt of the request;
- If the requesting agency is located in one of the remaining areas, it shall not exceed 03 working days from the date of receipt of the request.
* For the search for the issuance, replacement, and reissue of the people's identity card:
- In case the search requesting agency is located in a district, city, or town, it shall not exceed 03 working days from the date of receipt of the request, for the search in service of the issuance and replacement of the ID card; no later than 07 working days from the date of receipt of the request for the re-issuance of the citizen identity card;
- In case the search requesting agency is located in mountainous, highland, border, or island districts, it shall not exceed 10 working days from the date of receipt of the request;
- If the requesting agency is located in one of the remaining areas, it shall not exceed 07 working days from the date of receipt of the request.
(2) In case a unit in the police force requests to search and exploit information and documents to serve professional requirements, the time for the citizen identification archive management agency to conduct the search and reply to the results is prescribed as follows:
* For requests with urgency, urgency, and speed, no more than 8 hours from the time of receiving the request;
* For a request for sufficient information, no later than 05 working days from the date of receipt of the request;
* For requests that have to wait for verification, no more than 15 working days from the date of receipt of the request.
(3) In case of a request to search and exploit information and documents of other agencies, organizations, and individuals, the time for the citizen identification archive management agency to conduct the search and reply to the results is prescribed as follows:
* For requests according to procedures and clear information, no later than 07 working days from the date of receipt of the request;
* For the request to be verified, it must not be later than 20 working days from the date of receipt of the request.
