Regarding this issue, LawNet would like to answer as follows:
The functions and tasks of the Vietnam Women Talents Foundation are specified in Article 5 of the first (amended and supplemented) Charter of the Vietnam Women Talents Foundation issued together with Decision 441/QD-BNV in 2023 as follows:
- Use the Fund's assets to support and sponsor subjects, programs, and projects in accordance with the Fund's principles and purposes and the provisions of law.
- Receive and manage sponsored and aid assets under authorization from domestic and foreign organizations and individuals to carry out activities under the authorization contract in accordance with the Fund's principles and purposes and the provisions of law.
- Receive assets from domestic and foreign organizations and individuals who sponsor, donate, or take other forms according to the provisions of law to preserve and grow the Fund.
- Annually, organize the selection and awarding of Vietnamese Women's Awards to women groups and individuals according to the Fund's standards and provisions of law.
- Propagate and introduce the purpose, meaning, and activities of the Fund, and the achievements of Vietnamese women's collectives and individuals honored and awarded by the Fund on mass media according to the provisions of law to encourage and promote women's talents and, at the same time, raise awareness of the entire society about women's contributions to the country's development. Share and exchange experiences of female talents and make recommendations to promote the role of female talents.
- Powers of the Fund:
+ Organize and operate according to the law and Charter recognized by competent state agencies;
+ Mobilizing donations and sponsorship for the Fund; Receive assets sponsored, donated, or in other forms by domestic and foreign individuals and organizations in accordance with the Fund's purposes and provisions of law. Organize activities according to the provisions of the law to preserve and grow Fund assets;
+ Established an affiliated legal entity according to the provisions of the law;
+ Have the right to complain according to the provisions of law;
+ The Fund is allowed to coordinate with individuals and organizations to mobilize donations and sponsorship for the Fund or to implement specific schemes and projects of the Fund according to the provisions of law;
+ Coordinate with localities, organizations, and individuals that need assistance to develop and implement funding projects according to the Fund's operating purposes.
- Obligations of the Fund:
+ The Fund operates in any field and must comply with the management of the state agency in that industry or field. The Fund operates and can only receive and mobilize funding within the scope of its operations, according to the Fund's Charter;
+ Make grants according to the requests of authorized individuals and organizations in accordance with the Fund's purposes;
+ Store and be responsible for providing complete records, documents, and materials on the Fund's assets and finances, resolutions, and minutes on the Fund's activities to competent state agencies according to regulations of the Law;
+ Use assets and finances economically and effectively according to the Fund's purposes; pay taxes, fees, and charges; and implement accounting, auditing, and statistical regimes according to the provisions of law; must register for a tax code and declare taxes according to the provisions of tax law;
+ Subject to inspection, examination, and supervision by state agencies, sponsoring organizations, individuals, and the community according to the provisions of the law. Responsible for resolving complaints and denunciations within the Fund and reporting settlement results to competent state agencies;
+ Every year, the Fund is responsible for publicizing contributions in the mass media before March 31;
+ When changing the headquarters or Director of the Fund, the Fund must report in writing to the competent authority granting the Fund establishment license;
+ Every year, the Fund must report its organizational, operational, and financial situation to the agency that grants the Establishment License and recognizes the Fund Charter, and the state financial management agency at the same level as the agency competent to grant the Fund establishment license, the agency managing the Fund's sectors and fields of operation, and report to the Provincial People's Committee where the Fund is headquartered before December 31;
+ Implement decisions of competent state agencies related to the organization and operations of the Fund and other obligations according to the provisions of the law and the Fund's Charter.
