1. Conditions and authority to recognize traditional days in Vietnam

According to Article 5 Decree 111/2018/ND-CP, the conditions and authority to recognize traditional days in Vietnam are as follows:

- Conditions for Recognizing Traditional Days

+ There are historical documents indicating a specific day marked by a notable event;

+ The notable event must occur at least 10 years prior to the request for recognition;

+ It should have educational significance regarding historical traditions for ministries, central authorities, and local authorities.

- The Prime Minister of the Government of Vietnam decides to recognize the traditional days of ministries, central authorities, and provinces.

2. Application for recognition of traditional days in Vietnam

Application for recognition of traditional days in Vietnam according to Article 6 Decree 111/2018/ND-CP are as follows:

- Official Dispatch requesting recognition of the traditional day.

- A detailed explanation of the necessity, educational value, and significance of recognizing the traditional day.

- Copies of documents proving the inception or the date of the notable event.

- Appraisal document from the appraisal authority.

- Report discussing and addressing feedback and appraisal results.

3. Authorities appraising and appraising content of application for recognition of traditional days in Vietnam

Authorities appraising and appraising content of application for recognition of traditional days in Vietnam according to Article 7 Decree 111/2018/ND-CP are as follows:

- The Ministry of Culture, Sports, and Tourism is the authority responsible for appraising dossiers for recognizing traditional days.

- Content of Appraisal

+ Completeness and legality of the dossier;

+ Accuracy of the supporting documents;

+ Reasonableness and necessity of recognizing the traditional day.

4. Procedures for Recognizing Traditional Days of Ministries, Central Authorities, and Provincial authorities

The procedures for recognizing traditional days of ministries, central authorities, and provincial authorities in Vietnam according to Article 8 Decree 111/2018/ND-CP are as follows:

- Ministries, sectors, and provinces submit directly or send via post or electronically one complete dossier as per the provisions in Clauses 1, 2, and 3 Article 6 Decree 111/2018/ND-CP to the Ministry of Culture, Sports, and Tourism for appraisal.

- In case the dossier is incomplete, within 03 working days from the date of receipt of the dossier, the Ministry of Culture, Sports, and Tourism shall issue a written notice requesting additional documents. Upon receiving the notice, the requesting authority supplements the dossier and sends it back to the appraisal authority.

- In the case of a complete dossier, within 15 days from the date of receipt, the Ministry of Culture, Sports, and Tourism organizes the appraisal of the dossier and issues an appraisal document, which is sent to the requesting authority. If necessary, during the appraisal process, the Ministry of Culture, Sports, and Tourism may seek opinions from relevant agencies or units or request the requesting authority to provide explanations.

- The appraisal document must clearly state opinions on the content specified in Clause 2 Article 7 Decree 111/2018/ND-CP and provide a specific conclusion on whether the dossier meets the conditions to be submitted to the Prime Minister of the Government of Vietnam for consideration and recognition.

- After receiving the appraisal document from the Ministry of Culture, Sports, and Tourism, the requesting authority is responsible for reviewing, preparing a report to explain and address the appraisal comments, and supplementing and completing the dossier per the provisions in Article 6 Decree 111/2018/ND-CP for submission to the Prime Minister of the Government of Vietnam for consideration and decision.

5. Principles of Organizing Celebrations for Establishment and Traditional Days in Vietnam

The principles of organizing celebrations for establishment and traditional days according to Article 4 Decree 111/2018/ND-CP are as follows:

- Commemorative activities should be organized solemnly, safely, economically, without ostentation or formality.

- Celebrations for establishment or traditional days can only be organized if there is an establishment document or a recognition decision from the competent authority.

- Celebrations are held only on anniversary years. If ministries, central authorities, and provinces have both an establishment day, re-establishment day, and traditional day, they can only choose one of these days to hold a celebration.

- Gifts and banquets are not permitted during commemorative activities.
