The Government of Vietnam issued Decree 18/2025/ND-CP on February 8, 2025, guiding the Electricity Law 2024 related to electricity trading activities and ensuring power supply situations.

According to Clause 2, Article 6 of Decree 18/2025/ND-CP, it is stipulated that the electricity purchaser shall prepare a dossier proposing the conclusion of an electricity purchase contract for residential purposes in paper form or data message form equivalent to a document in accordance with the law, and send one set of documents to the electricity seller in case of paper form. The dossier for proposing the conclusion of an electricity purchase contract in Vietnam includes the following documents and materials:

- Proposal to conclude an electricity purchase contract for residential purposes;

- Personal identification number of the legal representative or authorized representative of the electricity purchaser as established by the National Database on Population.

In case the search fails in the National Database, use a copy of the identity card or citizen identity card or personal identification card or certificate of residence information of the representative of the electricity purchaser with information on the residence of the household at the electricity purchasing location or one of the following documents: Certificate of home ownership; certificate of land use rights (on land with a residential house); decision on housing section; house purchase contract; house rental contract with a term of 01 year or more, or other documents proving ownership, management, or use of the electricity purchasing location with a term of 01 year or more for electricity registration.

Regulation on recording residential electric energy index in Vietnam

According to Article 7 of Decree 18/2025/ND-CP, guidance on recording the electric energy index for electricity trading used for residential purposes is as follows:

- For electricity trading used for residential purposes, the electricity seller records the electric energy index once a month on a fixed day agreed upon by both parties in the electricity purchase contract, except in force majeure circumstances that pose a safety risk to workers stipulated in the electricity purchase contract. The recording time point of the electric energy index may be shifted one day before or after the fixed day or adjusted according to the agreement in the electricity purchase contract.

- For electricity trading used for non-residential purposes, the electricity purchaser and seller are allowed to agree on the number of times the electric energy index is recorded per month. If no agreement is reached, the recording of the electric energy index is stipulated based on the registered average monthly electricity consumption in the purchase contract as follows:

+ Less than 50,000 kWh/month, record the index once a month;

+ From 50,000 to 100,000 kWh/month, record the index twice a month;

+ Over 100,000 kWh/month, record the index three times a month.

- In case the actual average electricity consumption of the electricity purchaser for non-residential purposes in the last three months exceeds or is lower than the consumption thresholds corresponding to the index recording frequencies applied per point a, b, and c, Clause 2, Article 7 of Decree 18/2025/ND-CP, the electricity seller and buyer may agree to adjust the number of times the electric energy index is recorded.

- For electricity purchasers using less than 15 kWh/month of electricity, the electric energy index recording cycle is negotiated by both parties.

- For wholesale electricity trading, the recording of the electric energy index is negotiated by both parties in the contract.

- The electricity seller must ensure the accuracy of the recorded electric energy index.

Decree 18/2025/ND-CP takes effect from February 8, 2025.
