Regarding this issue, LawNet responded as follows:

1. Who is an officer of the Vietnam People's Army?

Officers of the Vietnam People's Army (hereinafter referred to as officers) are cadres of the Communist Party of Vietnam and the State of the Socialist Republic of Vietnam, active in the military field, and has been conferred the military ranks of Lieutenant, Colonel, and General by the State.

(Article 1 of the Law on Officers of the Vietnam People's Army 1999 (amended in 2008))

2. Annual leave for officers of the Vietnam People's Army

According to Article 4 of Circular 153/2017/TT-BQP, the annual leave regime for officers of the Vietnam People's Army is as follows:

(i) Officers are entitled to annual leave as follows:

- Under 15 years of working, 20 days off;

- From full 15 years working to less than 25 years working, 25 days off;

- From full 25 years of full service or more, they are entitled to 30 days of leave.

(ii) Officers in units stationed far from their families (husband or wife; natural or legally adopted children; father and mother (both husband and wife); legal caregivers) when taking annual leave are entitled to additional leave:

- 10 days for cases:

+ To be stationed at a distance of 500 km or more from his family;

+ To station troops in remote, isolated, and border areas at least 300 km away from their families;

+ To station troops on the islands of the Truong Sa and DK archipelagos.

- 05 days for the following cases:

+ To be stationed at a distance of 300 km to less than 500 km from his family;

+ To station troops in remote and border areas at least 200 km away from their families and with a regional coefficient of 0.5 or more;

+ To station troops on islands entitled to regional allowances.

(iii) Officers specified in Clause (ii) cannot take annual leave due to duty requirements, the unit commander shall consider and decide to allow his subordinate officers to take compensatory leave for the previous year. In special cases, due to the requirements of the unit's tasks, it is still not possible to arrange for the officers to go on leave according to the provisions of Circular 13/2012/TT-BQP.

(iv) Travel time is not included in the number of annual leave days as prescribed in clauses (i), (ii).

(v) Annually commanding units from regimental level and above, based on the duty of combat readiness, training, and work of the unit, and planning for officers to take leave, the regular leave rate should not exceed 15% of the total number of officers of the unit. Non-blocking units are ready to fight, depending on the nature and requirements of the mission. Academies and schools mainly arrange for officers to take leave in the summer.

3. Officers' leave regime in Vietnam

- Active duty officers are entitled to the following leave regimes:

+ Annual leave;

+ Special leave;

+ Holidays and New Year's holidays;

+ Nursing rest;

+ Weekly rest;

+ Retirement preparation.

- During the time off as prescribed above, officers are entitled to full salary and allowances and are paid leave according to the provisions of Circular 13/2012/TT-BQP stipulating the leave payment regime for salaried employees working in military agencies and units.
