Below, Lawnet would like to introduce the policies in the fields of tax, fees, charges, and finance in Vietnam that take effect from October 2016.
- Guidelines for Using Electronic Customs Declaration Information
These guidelines are mentioned in Decision 33/2016/QD-TTg (effective from October 15, 2016) regarding the Regulation on providing and using electronic customs declaration information, issued by the Prime Minister of Vietnam.
The General Department of Customs of Vietnam provides electronic customs declaration information to the information users, including:
- State management agencies use electronic customs declaration information for tax procedures, issuing certificates of origin for goods, and other administrative procedures; checking the legality of goods circulating in the market;- Credit institutions use electronic customs declaration information for tax procedures and bank payment procedures;- Organizations authorized by the Ministry of Industry and Trade to issue certificates of origin for goods;
The provision and use of electronic customs declaration information are carried out as follows:
- Information users access the Customs Information Portal using an account issued by the General Department of Customs to use electronic customs declaration information in electronic document form;- Information users connect their information systems with the Customs Information Portal to use electronic customs declaration information in electronic data form;- Inspection agencies use electronic customs declaration information in the form of messages provided by the General Department of Customs through officially announced phone numbers.
Furthermore, within no more than 01 minute of receiving the request, the Customs Information Portal will respond to the information users with the following:
- Electronic customs declaration information; or- Notification of reasons in case of system failure or absence of electronic customs declaration information.
- Import Tariff Quotas for Raw Tobacco and Poultry Eggs
Circular 16/2016/TT-BCT regulates the application of import tariff quotas for raw tobacco and poultry eggs originating from member countries of the Eurasian Economic Union in 2016 as follows:
- The import tariff quota for poultry eggs (Birds' eggs, in shell, fresh, preserved or cooked) is 8,000 dozen;- The import tariff quota for raw tobacco (Unmanufactured tobacco leaves; tobacco leaf waste) is 500 tons.
Imported goods must have a Certificate of Origin issued by the competent authority of the member countries of the Eurasian Economic Union (abbreviated as C/O form EAV). For raw tobacco, Vietnamese traders must have an import license for raw tobacco under the tariff quota according to the provisions of Circular 04/2014/TT-BCT.
- Increase in Road Use Fees at Ban Thach Toll Station on National Highway 1 in Vietnam
The Ministry of Finance has issued Circular 131/2016/TT-BTC stipulating the collection, payment, management, and use of road use fees at Ban Thach Toll Station (at Km1298+150) on National Highway 1.
The fee collection according to the rates in Circular 131 will commence upon meeting the following conditions:
- The construction of Co Ma Tunnel (part of the Project for building road tunnels through Deo Ca) on National Highway 1 has been inspected and accepted by the Ministry of Transport and handed over for use by the Investor;- The Ministry of Transport has issued a Decision allowing the fee collection at the rates specified in this Circular.
Circular 131/2016/TT-BTC takes effect from October 01, 2016. Circular 97/2013/TT-BTC ceases to be effective from the date the Ministry of Transport allows the fee collection at Ban Thach Toll Station (at Km1298+150) on National Highway 1.

Thus, the road use fee at Ban Thach Toll Station specified in Circular 131 is significantly higher than that stipulated in Circular 197.
