Latest Adoption Fees according to Decree 114/2016/ND-CP

Decree 114/2016/ND-CP was promulgated by the government on July 08, 2016, stipulating fees for adoption registration and licensing fees for the activities of foreign adoption organizations. It supplements several new points as follows:

Regarding the contents related to adoption fees for individuals and organizations from January 1, 2017, Decree 114/2016/ND-CP will be applied instead of Decree 19/2011/ND-CP as stipulated.

The Decree partially repeals Decree 19/2011/ND-CP, specifically the phrases “adoption registration fees”, “collection levels, policies governing, and usage of fees” in Clause 1 Article 1; the phrases “Clause 1 and” in Clause 3 Article 38; the provisions in Clause 1 Article 38 and Articles 39, 40, 41, 42, 43, 44, 45, and 46 of Decree No. 19/2011/ND-CP dated March 21, 2011, of the Government of Vietnam detailing the implementation of several provisions of the Law on Adoption are nullified.

Supplementary Adoption Fee Exemptions

Based on the provisions at Points b and c, Clause 1, Article 4 of this Decree, the following cases will be exempt from adoption registration fees:

- Individuals adopting the following children: Disabled children, children infected with HIV/AIDS, or children with severe illnesses as prescribed by the Law on Adoption and its guiding documents;- Individuals recognized as having made contributions to the revolution adopting children.

Reduction of Adoption Fees for Foreign-related Adoptions:

The specified levels for adoption fees in cases specified in Points b, c, and d, Clause 1, Article 6 of the Decree are as follows:

- Foreigners residing in Vietnam adopting Vietnamese children: 4,500,000 VND/case.- Foreigners residing in border areas of neighboring countries adopting Vietnamese children residing in the Vietnamese border area: 4,500,000 VND/case.- Adoption registration fees at Vietnamese representative offices abroad: 150 USD/case. This fee is converted to the local currency based on the selling rate of the USD as announced by the bank where the Vietnamese representative office's account is held.

Decree 114/2016/ND-CP takes effect from January 1, 2017.
