Vietnam: The validity period of electricity operating licenses may be shortened

This is a new point of Circular No. 12/2017/TT-BCT of the Ministry of Industry and Trade of Vietnam on procedures for issuance and revocation of electricity operating licenses.

According to Circular No. 12/2017/TT-BCT of the Ministry of Industry and Trade of Vietnam, the maximum validity period of electricity operating licenses is specified as follows:

- Electricity consulting services: 05 years;

- Electricity generation: 20 years (power plants included in the list of power plants that have key importance for society and economy and national defense and security) and 10 years (power plants not included in the list of power plants that have key importance for society and economy and national defense and security);

- Electricity transmission: 20 years;

- Electricity distribution: 10 years;

- Electricity wholesaling, electricity retailing: 10 years;

- Export or import of electricity: 10 years.

The new point of Circular No. 12/2017/TT-BCT is:

- An electricity operating license with a shorter validity period may be granted upon request of the applicant.

- According to actual conditions of the section in the electricity work, license issuing authority may grant an electricity operating license with a validity period shorter than the maximum one.

Circular No. 12/2017/TT-BCT of the Ministry of Industry and Trade of Vietnam takes effect from September 14, 2017, replacing Circular No. 10/2015/TT-BCT.
