On February 08, 2025, the Government of Vietnam issued Decree 18/2025/ND-CP guiding the Electricity Law 2024 related to electricity trading activities and ensuring power supply situations.
According to Clause 2, Article 6 of Decree 18/2025/ND-CP, the electricity buyer shall prepare a dossier for proposing the execution of a power purchase agreement for household purposes either in paper form or as a data message having equivalent legal value, and send one set of the dossier to the electricity seller if in paper form. The dossier proposing the execution of the power purchase agreement includes the following documents and materials:
- Proposal to execute the power purchase agreement for household purposes;
- Personal identification number of the legal or authorized representative of the electricity buyer as established by the National Database on Population. In cases where it cannot be obtained from the National Database, a copy of the identity card, citizen identity card, or a verification of residency information of the representative of the electricity buyer with details of the household's residence at the power purchase location can be used instead, or any one of the following documents:
+ Certificate of home ownership;
+ Land use right certificate (on land with an existing home);
+ House allocation decision;
+ House purchase contract; house lease contract with a term of at least one year or other documents proving ownership, management, or use of the power purchase location for a term of at least one year for electricity registration.
Additionally, the power purchase agreement for household purposes must include the main contents stipulated in Clause 3, Article 44 of the Electricity Law 2024, including:
- Information about the parties in the contract including: name, address, phone number, other contact methods (if any);
- Standards, service quality, and address of electricity use;
- Retail electricity price, method, and payment deadline;
- Rights and obligations of the parties;
- Responsibility to protect information of the electricity buyer;
- Cases of contract termination and arising liabilities due to contract termination;
- Force majeure circumstances as per civil law regulations;
- Dispute resolution methods;
- Contract execution time, contract duration;
- Agreement on penalty for violations;
- Other contents agreed upon by both parties.
Note:
- Regulations on the power purchase agreement for household purposes stipulated in Article 11 of Decree 137/2013/ND-CP have been amended and supplemented as per the provisions in Article 8 of Decree 104/2022/ND-CP, and the provisions on ensuring the execution of the power purchase agreement, power quality, electric meter reading stipulated in Articles 12, 15, and 17 of Decree 137/2013/ND-CP have ceased to be effective from the date that Decree 18/2025/ND-CP comes into effect.
- For power purchase agreements signed before the effective date of Decree 18/2025/ND-CP, they shall continue to be implemented according to the signed agreements. For customers who have fulfilled contract assurances in accordance with Decree 137/2013/ND-CP falling under the circumstances stipulated in Clause 4, Article 3 of Decree 18/2025/ND-CP, they shall have the right to request the electricity seller to amend the power purchase agreement in accordance with Decree 18/2025/ND-CP.
