Recently, the Supreme People's Court issued Official Dispatch 109/TANDTC-PC regarding the adjudication of cases related to the prevention and control of the Covid-19 pandemic.
The Supreme People's Court of Vietnam (TANDTC) requests Chief Justices of People's Courts, Chief Justices of Military Courts at all levels, and Heads of units under the TANDTC, within the scope of their functions and duties, to proactively cooperate with judicial agencies to promptly bring to trial cases related to:
- Crimes of violating exit and entry regulations;- Crimes of illegally staying in Vietnam (Article 347);- Crimes of organizing and brokering for others to exit or stay in Vietnam illegally (Article 348);- Crimes of organizing and brokering for others to escape abroad or stay abroad illegally (Article 349);- Crimes of coercing others to escape abroad or stay abroad illegally (Article 350).
For localities with cases of Covid-19 in the community, based on the actual situation, the TANDTC recommends that the Chief Justices of Provincial People's Courts, Chief Justices of Military Courts at the military zone level proactively organize trials or temporarily halt trials to ensure the effective implementation of Covid-19 prevention and control measures in accordance with the directives of the Prime Minister of the Government of Vietnam on prevention and control of Covid-19 and the directive of the Chief Justice of the Supreme People's Court at Official Dispatch 289/TANDTC-VP dated July 27, 2020.
