On November 19, 2024, the Ministry of Culture, Sports, and Tourism of Vietnam issued Decision 3520/QD-BVHTTDL regarding the announcement of revised and supplemented administrative procedures in the field of Culture under the management function of the Ministry of Culture, Sports, and Tourism of Vietnam.
* Implementation Sequence:
- Enterprises or business households with a location for dance hall services within the area shall submit directly or via postal service or electronically 01 dossier according to the regulations to the Department of Culture, Sports, and Tourism/Department of Culture and Sports (collectively referred to as the receiving agency).
- In case the dossier is unsatisfactory, within 01 working day from the date of receipt, the receiving agency shall issue a written notification requesting completion of the dossier.
- In case the dossier is complete according to regulations, within 03 working days from the date of receipt, the receiving agency shall appraise the dossier, report to the Provincial People's Committee to establish an Inspection Team at the dance hall service business location (hereinafter referred to as the Inspection Team) regarding business conditions as prescribed to advise the competent authority to decide on granting or not granting the Business Eligibility License. The composition of the Inspection Team shall not exceed 07 members, including representatives from agencies: Police, Culture, Construction, and other related agencies.
- Within 04 working days from the date of establishment, the Inspection Team shall organize the appraisal and issue the appraisal results according to the prescribed form.
- Within 03 working days from the date of having the appraisal results, the Provincial People's Committee shall be responsible for issuing or delegating, authorizing the specialized agency to issue the Business Eligibility License for dance hall services according to the prescribed form or not issue the License. In case of not issuing the License, a written response with clear reasons must be given.
- The competent authority shall send 01 copy of the License to the enterprise or business household granted the Business Eligibility License for dance hall services, the agency issuing the enterprise or business household registration certificate, the district-level police agency where the business is conducted, and retain 01 copy of the License at the license issuing agency, the receiving agency; post on the electronic information page of the Business Eligibility License issuing agency.
* Method of Execution: Submit directly or via postal service or electronically to the Department of Culture, Sports, and Tourism/Department of Culture and Sports.
* Dossier Components:
(1) Application for issuance of Business Eligibility License for dance hall services (Form No. 01 in the Appendix issued with Decree 148/2024/ND-CP).
(2) Certified copy or copy presented with the original for comparison of the Certificate of Eligibility for Security and Order.
* Fees and Charges:
- In centrally run cities and city and district-level townships under provinces: The fee for appraisal and issuance of the License is 15,000,000 VND/license;
- In other areas: The fee for appraisal and issuance of the License is 10,000,000 VND/license.
* Requirements and Conditions for Administratve Procedures Execution:
- Must be an enterprise or business household established in accordance with the law;
- Ensure conditions for fire, explosion prevention, and security and order as prescribed in Decree 96/2016/ND-CP dated July 1, 2016, and Decree 56/2023/ND-CP dated July 24, 2023, by the Government of Vietnam;
- The dance hall room must have a usable area of 80m2 or more, excluding auxiliary works;
- Doors inside the dance hall room must not have locks, and alarm devices may not be installed (except for fire, explosion alarms);
- The business location must be at least 200m away from schools, hospitals, religious, belief establishments, and historical - cultural relics.
