On May 8, 2023, the Ministry of Industry and Trade of Vietnam issued a href="https://lawnet.vn/vb/Thong-tu-11-2023-TT-BCT-han-ngach-thue-quan-nhap-khau-thuoc-la-nguyen-lieu-8A28F.html" class="green-text" target="_blank" >Circular 11/2023/TT-BCT on tariff quotas for importing raw tobacco in 2023.

Tariff quota on raw tobacco imports in 2023 in Vietnam

The tariff quota amount for importing raw tobacco (HS code 2401) in 2023 is 68,414 tons.

Tariff quotas for importing raw cigarettes are assigned to traders who have a cigarette production license issued by the Ministry of Industry and Trade and have a need to use imported raw cigarettes for cigarette production.

Method of administering tariff quotas for importing raw tobacco in Vietnam

Tariff quotas for importing raw tobacco are implemented according to the allocation method prescribed in Decree 69/2018/ND-CP, dated May 15, 2018 and Circular 12/2018/TT-BCT, dated June 15, 2018.

Issuance of a license to import raw tobacco according to tariff quotas in Vietnam

The granting of licenses to import raw tobacco under tariff quotas is carried out in accordance with the provisions of Clauses 2 and 3, Article 15 of Circular 12/2018/TT-BCT, specifically as follows:

(1) The application for a License to import raw tobacco under tariff quotas shall comply with the provisions of Points a and b, Clause 1, Article 9 of Decree 69/2018/ND-CP, specifically as follows:

- Import tariff quota registration application according to the form specified in Appendix XIII attached to Circular 12/2018/TT-BCT: 1 original copy.

- Investment certificate or Business registration certificate or Enterprise registration certificate: 1 copy with the trader's stamp.

(2) The process of granting a License to import raw tobacco under tariff quotas is implemented according to the provisions of Clause 2, Article 9 of Decree 69/2018/ND-CP, specifically as follows:

- Traders submit 1 set of documents according to Section (1) directly, by post, or online (if applicable), to the Ministry of Industry and Trade (Department of Import and Export).

- In the event that the dossier is not complete in accordance with regulations or additional explanatory documents are needed, within 3 working days from the date of receiving the dossier, the Ministry of Industry and Trade shall notify the trader to complete the dossier.

- The time limit for granting import licenses under tariff quotas to traders is 10 working days from the time of assignment as prescribed in Clause 5, Article 14 of Circular 12/2018/TT-BCT, and the Ministry of Industry and Trade received a complete set of documents in accordance with regulations.

In the event of not granting a license, the Ministry of Industry and Trade will respond to the trader in writing and clearly state the reason.

Circular 11/2023/TT-BCT takes effect on June 23, 2023, to December 31, 2023.
