Regulations on the reporting time for the implementation of bidding activities in Vietnam

The Minister of Planning and Investment of Vietnam has issued Circular 23/2024/TT-BKHDT on December 31, 2024, providing detailed regulations on the templates for requests, evaluation reports, appraisal reports, inspections, and reports on the implementation status of bidding activities.

Regulations on the reporting time for the implementation of bidding activities in Vietnam

The reporting timelines for the implementation of bidding activities in Vietnam are as follows:

(1) The Ministry of Planning and Investment reports to the Prime Minister of the Government of Vietnam in the second quarter of the following year of the reporting period.

(2) Ministries, ministerial-level agencies, agencies under the Government of Vietnam, other central agencies, provincial People's Committees, and state-owned enterprises submit reports on the National E-Bidding System before February 1 of the following year of the reporting period. If this reporting date coincides with a weekly holiday or public holiday as regulated by labor laws, the reporting date will be the first working day following the holiday or public holiday.

(3) Investors and bid solicitors submit annual reports on bidding activity implementation according to the deadlines set by the Department of Planning and Investment or the unit assigned to manage bidding activities.

Additionally, agencies and organizations are to report on the implementation of bidding activities as follows:

- Annually, the Ministry of Planning and Investment consolidates and reports to the Prime Minister of the Government of Vietnam on the nationwide implementation of bidding activities.

- Ministries, ministerial-level agencies, agencies under the Government of Vietnam, other central agencies, provincial People's Committees, state-owned enterprises, and other organizations subject to provisions in Article 2 of the Law on Bidding 2023 report annually on bidding activity implementation within their jurisdictions, sectors, or managed fields on the National E-Bidding System or submit written reports to the Ministry of Planning and Investment in cases where confidentiality is required.

- The Department of Planning and Investment, or the unit assigned with the task of managing bidding activities, assists ministries, ministerial-level agencies, agencies under the Government of Vietnam, other central agencies, provincial People's Committees, state-owned enterprises, and other organizations in monitoring, consolidating annual reports on bidding activity implementation of investors and bid solicitors within their jurisdictions, sectors, or managed fields.

- Investors and bid solicitors report on the bidding activity implementation of their packages and projects to the Department of Planning and Investment, or the unit assigned to manage bidding activities as stipulated in Clause 3, Article 3 of Circular 23/2024.
