Steps to process documents requesting approval for the joint organization of foreign language certification exams in Vietnam

In particular, instructions for handling dossiers of applications for approval for the joint organization of foreign language proficiency certification exams are as follows:

(1) In case the application is incomplete or does not meet the requirements in Clause 2, Article 3 of this Regulation:

Within 5 working days from the date of receipt of the dossier, the Department of Quality Management shall notify in writing and send it directly, by post, or email, to the parties requesting approval of the association to organize the examination for granting certificates of human resources and to continue to complete the dossiers.

(2) In case the application is complete, it meets the requirements in Clause 2, Article 3 of this Regulation:

The Department of Quality Management shall submit to the Minister of Education and Training for a decision on the establishment of the Council to appraise the dossiers and approve the joint organization of examinations for the grant of foreign human resources certificates.

- Members of the Appraisal Council include: the Chairman of the Council is the leader of the Quality Management Department; Council members are representatives of leaders and experts of the Department of Quality Management, the Department of International Cooperation, the Department of Continuing Education, the Department of Planning and Finance, the Department of Information Technology, and the National Foreign Language Project Management Board. The Appraisal Council works under the direction of the Chairman of the Council on the principle of collectivity and makes decisions by majority (decisions are made according to the unanimous opinion of 2/3 of the Council's members);

- A member of the Appraisal Council is responsible for appraising the contents of the application file for approval to link the organization of the foreign language proficiency exam with the provisions of Decree 86/2018/ND-CP and Circular 11/2022/TT-BGDDT according to the functions and tasks of units under the Ministry of Education and Training of Vietnam.

The members of the Appraisal Council are responsible for transferring the appraisal slip (according to the Appendix attached to this decision) to the Quality Management Department for synthesis within 07 days.

After 07 days, if a member fails to transfer the appraisal form to the Quality Management Department, it is understood that he/she agrees with the application file;

- The Quality Management Department sends dossiers to the members of the Appraisal Council, including:

An application form for approval of the association of a foreign national competency certification exam organization, an agreement or contract between the examination organization in Vietnam and the foreign national competency assessment establishment,
a document certifying the legal status of the associated parties, a project to organize an exam to issue a certificate of human resources, an assessment sheet (specifying the time of completion by members) for the council member to appraise the dossier;

- In case a member of the appraisal team has comments to request the affiliated parties supplement the dossier, the Quality Control Department shall notify in writing the contents that need to be completed to the related parties right after the expiration of the appraisal time limit specified at Point b, Clause 2, Article 4 of this Regulation;

- In case of necessity, the Appraisal Council shall work with and directly inspect the affiliated parties requesting approval for the joint organization of the examination for the grant of foreign national competency certificates.

(3) If the application file for approval of the association to organize the examination for the granting of foreign competency certificates meets the conditions and meets the requirements as prescribed, the Quality Management Department submits it to the Minister of Education and Training for approval.

Decision 896/QD-BGDDT takes effect from the date of signing and promulgation.
