The following article discusses the naming and use of seals after the organizational restructuring in Vietnam as stipulated in Resolution 190/2025/QH15.

On February 19, 2025, the National Assembly of Vietnam adopted Resolution 190/2025/QH15 stipulating the handling of issues related to reorganizing the state apparatus.
Article 3 of Resolution 190/2025/QH15 stipulates the names and use of seals by agencies, titles of authority after reorganizing the state apparatus as follows:
- When reorganizing the state apparatus, the names of agencies, titles of authority stipulated in documents are changed to the name of the agencies, titles receiving the functions, tasks, authorities.
- Agencies, titles of authority that change after reorganizing the state apparatus are to use seals, carry out the procedure to register seal samples, and hand over seals in accordance with the law.
Furthermore, the implementation of functions, tasks, and authorities of agencies, titles of authority after reorganizing the state apparatus is carried out as specifically stipulated in Article 4 of Resolution 190/2025/QH15 as follows:
- When reorganizing the state apparatus, functions, tasks, and authorities of agencies, titles of authority as prescribed by law continue to be implemented by agencies, titles receiving such functions, tasks, authorities.
- In cases when reorganizing the state apparatus results in changes to names, functions, tasks, authorities, positions, models, or organizational structures of post-reorganization agencies, the competent authorities may issue regulations defining different functions, tasks, authorities, and organizational structures from those in legal documents previously issued by superior state agencies, provided they conform to the approved reorganization plan.
- When reorganizing the state apparatus, if the number of deputy heads in an agency exceeds the legal maximum, the number of deputy heads must comply with regulations no later than 5 years from the effective date of the reorganization decision by the competent authority.
- If current documents stipulate coordination responsibilities between reorganized and other agencies, the agency receiving functions, tasks, and authorities from a reorganized agency assumes responsibility for continuing such tasks as per regulations.
- Agencies receiving functions, tasks, and authorities after the reorganization of the state apparatus continue handling ongoing procedures and tasks previously carried out by agencies subject to reorganization. If issues arise in procedures or tasks ongoing or completed before reorganization that require resolution thereafter, the receiving agency is responsible to cooperate with related agencies to address the arising issues.
- Supervision, inspection, auditing, and oversight of agencies formed or receiving functions, tasks, authorities after state apparatus reorganization are conducted in accordance with law and must ensure continuity without gaps or overlaps in the scope of supervisory authority while not disrupting the normal activities of the agencies under supervision.
