Salary arrangement for managers of single-member limited liability companies of which 100% charter capital is held by the State of Vietnam

On February 23, 2024, the Government of Vietnam issued Decree 21/2024/ND-CP amending Decree 51/2016/ND-CP stipulating the management of labor, salary, and bonuses for employees working in one-member limited liability companies wholly owned by the State and Decree 52/2016/ND-CP on salaries, remuneration, and bonuses for managers of single-member limited liability companies of which 100% charter capital is held by the State of Vietnam.

Amendment to the Regulations on Salary Arrangement for Management Personnel and Dedicated Supervisors of single-member limited liability companies of which 100% charter capital is held by the State of Vietnam as stipulated in Article 3 of Decree 52/2016/ND-CP is as follows:

- Based on the organizational management structure, the Members' Council or the Company President shall develop and issue the salary scale and salary classification for management personnel and dedicated supervisors, serving as the basis for implementing social insurance, health insurance, unemployment insurance, and other policies in accordance with labor law.

- The salary levels in the salary scale determined by the Members' Council or the Company President must ensure that the total salary fund, calculated according to the salary levels in the salary scale, does not exceed the planned salary fund for management personnel and dedicated supervisors as stipulated in this Decree.

- When developing or amending the salary scale for management personnel and supervisors, the Members' Council or the Company President must consult with the labor representative organization at the establishment, organize a workplace dialogue as prescribed, report to the representative agency of the owner for approval, and disclose it at the company before implementation.

Decree 21/2024/ND-CP shall take effect from April 10, 2024.

The policies regarding the salary fund, salary payment, remuneration, and bonuses stipulated in Clause 2, Article 1, and Clauses 3, 4, 6, 7, and 10 of Article 2, Decree 21/2024/ND-CP shall be implemented from January 01, 2024.
