According to the recent directive of the Department of Teachers and Educational Management Officers - Ministry of Education and Training in Official Dispatch 1125/NGCBQLGD-CSNGCB, female teachers whose maternity leave coincides with the summer vacation will have their cases resolved by the educational institution in the following two ways:
- First, arrange annual leave time according to the provisions of Article 111 and Article 112 of the Labor Code;- Second, pay annual leave allowances for teachers in cases where the educational institution cannot arrange annual leave time for teachers according to the provision of Article 114 of the Labor Code.
The level of support for teachers in cases where annual leave time cannot be arranged is stipulated in Clause 2, Article 5 of Circular 141/2011/TT-BTC.
The Department of Teachers and Educational Managers suggests that educational and training institutions guide the heads of educational institutions to resolve maternity policies for teachers in a manner conformable as stated above.
