Orientation for Solving Bank Action, Ambiguous Judgment, Difficult to Enforce

On October 16, 2017, the Supreme People's Court issued Directive 05/2017/CT-CA regarding the resolution of unclear and difficult-to-enforce judgments and decisions.

To rectify and address the inadequacies of unclear and difficult-to-enforce judgments and decisions, the Chief Justice of the Supreme People's Court requests:

- The High People's Courts, Provincial People's Courts, and District People's Courts update the Supreme People's Court software system Statistical Forms (Form 8c) before the 5th day of each month;- The High People's Courts:- Review and resolve cases with official dispatches from Civil Judgment Enforcement Agencies, or requests from local People's Courts for clarification, rectification, or consideration of cassation procedures, retrial of unclear and difficult-to-enforce judgments and decisions;- In cases where an explanation or rectification has been provided but the Civil Judgment Enforcement Agency deems it inappropriate or incorrect, a written request must be sent to the Civil Judgment Enforcement Agency and the Provincial People's Procuracy to report to the Ministry of Justice.
