On August 20, 2024, the Government of Vietnam issued Decree 107/2024/ND-CP annulling certain legislative documents of the Government of Vietnam.

Official annulment of 10 Decrees issued by the Government of Vietnam from August 20, 2024

To fully annul 10 Decrees issued by the Government of Vietnam from August 20, 2024 including:

- Decree 78-CP, 1997, stipulating military insignia, ranks, ceremonial uniforms, military flags, control badges, working signs, captain's flags, and identification cards of the Border Guard;

- Decree 103/2002/ND-CP stipulating policies on compensation and allowances for individuals, families, agencies, organizations participating in drug prevention and control who suffer loss of life, health, and property;

- Decree 04/2003/ND-CP stipulating rewards for individuals, families, agencies, organizations having achievements in drug prevention and control;

- Decree 18/2005/ND-CP on the establishment, organization, and operation of mutual insurance organizations;

- Decree 120/2007/ND-CP guiding the Youth Law;

- Decree 30/2009/ND-CP amending Decree 105/2004/ND-CP on independent audit;

- Decree 01/2011/ND-CP on the issuance of Government bonds, bonds guaranteed by the Government of Vietnam, and local government bonds;

- Decree 16/2011/ND-CP amending Decree 105/2004/ND-CP on independent audit;

- Decree 78/2017/ND-CP amending Decree 120/2007/ND-CP guiding the Youth Law;

- Decree 161/2018/ND-CP amending regulations on the recruitment, use, and management of officials and public employees, promotion of officials, ranking of public employees, and implementing contractual policies for certain jobs in state administrative agencies and public service providers.

More details can be found in Decree 107/2024/ND-CP, which comes into force in Vietnam from August 20, 2024.

It is known that the Government of Vietnam issues decrees to stipulate:

- Details on articles, clauses, and points assigned in laws, resolutions of the National Assembly, ordinances, resolutions of the Standing Committee of the National Assembly, orders, and decisions of the President.

- Specific measures to implement the Constitution, laws, resolutions of the National Assembly, ordinances, resolutions of the Standing Committee of the National Assembly, orders, and decisions of the President; measures to implement socio-economic policies, national defense, security, finance, monetary policies, budget, taxation, ethnicity, religion, culture, education, health, science, technology, environment, foreign affairs, public service policies, officials and public employees, rights, obligations of citizens, and other issues under the management, administration authority of the Government of Vietnam; issues related to the duties and powers of two or more ministries, ministerial-level agencies; duties, powers, organizational structure of ministries, ministerial-level agencies, agencies under the Government of Vietnam, and other agencies under the authority of the Government of Vietnam.

- Issues within the jurisdiction of the National Assembly, the Standing Committee of the National Assembly, but lack adequate conditions to be formulated into laws or ordinances to meet state management, economic management, and social management requirements. Before issuing such a decree, it must be approved by the Standing Committee of the National Assembly.
