On December 30, 2022, the Government of Vietnam promulgated Decree No. 115/2022/ND-CP on Vietnam’s preferential export tariff schedule and special preferential import tariff schedule for the implementation of the Comprehensive and Progressive Agreement for Trans-Pacific Partnership 2022-2027.
According to the Decree, conditions for applying special preferential export tariff rates under the CPTPP Agreement are as follows:
Imports will be eligible for the special preferential import tariff under the CPTPP Agreement if:
- They are included in the special preferential import tariff schedule or the list of goods and special preferential import tariff rates for used cars subject to tariff-rate quotas of Vietnam for the implementation of the CPTPP Agreement prescribed in Appendix II of Decree No. 115/2022/ND-CP.
- They are imported into Vietnam from member countries under the CPTPP Agreement, including:
+ Australia;
+ Canada;
+ Japan;
+ United Mexican States;
+ New Zealand;
+ Republic of Singapore;
+ Republic of Peru.
- They satisfy regulations on the origin of goods and have documents proving the origin of goods under the CPTPP Agreement.
Decree No. 115/2022/ND-CP comes into force as of December 30, 2022 and replaces Decree No. 57/2019/ND-CP and Decree No. 21/2022/ND-CP.
