Instructions for handling bidding documents on consultancy service under the CPTPP and EVFTA Agreement in which the bids will be opened before November 20, 2022

The Minister of Planning and Investment promulgated Circular No. 20/2022/TT-BKHDT dated September 30, 2022 providing instructions for preparation of bidding documents on consultancy service for contract packages regulated by CPTPP, EVFTA and UKVFTA Agreements.
 
According to the Circular, instructions for handling of bidding documents on consultancy service under CPTPP, EVFTA and UKVFTA Agreements in which the bids will be opened before November 20, 2022 include:

- The bid evaluation and consideration for contract award shall be done in accordance with the bidding documents and not in contravention of the CPTPP, EVFTA and UKVFTA Agreements.
 
- Regarding contract packages in which the bidding documents have been issued before November 20, 2022 but the deadline for submission of bids is after November 20, 2022 and the deadline has not reached:

Any information inappropriate or in contravention of the templates of bidding documents issued herewith must be modified accordingly.
 
If the bidding documents are modified after being issued, the investor and procuring entity must give the bidders a reasonable amount of time to prepare their bids.
 
- Regarding contract packages in which the bidding documents have been approved before November 20, 2022 but the bidding documents have not been issued, the templates of bidding documents issued together with Circular No. 20/2022/TT-BKHDT shall be modified.
 
Circular No. 20/2022/TT-BKHDT comes into force from November 20, 2022.
