Recently, the Ho Chi Minh City Social Insurance issued Official Dispatch 2219/BHXH-CD on November 7, 2018, to guide the professional operations of policies regarding illness, maternity, and convalescence.
Notably, according to Clause 6, Article 34 of the Social Insurance Law 2014, if the mother, after giving birth, is not in good health to care for the child, the father is entitled to maternity leave to care for the child until the child reaches 6 months old, regardless of the duration of social insurance contributions.
Male employees participating in social insurance are allowed to take leave multiple times when their wife gives birth and are still entitled to maternity benefits, but the total leave period must not exceed the prescribed time and must be taken within 30 days.
Female employees who have paid social insurance for 12 months or more, have quit their job but have contributed to social insurance for at least 3 months within 12 months before giving birth, are entitled to maternity benefits if there is a medical recommendation for prenatal rest.
