Guidelines for recruitment, use, and management of officials working at a commune or town and ward-level officials in Ho Chi Minh City, Vietnam

On February 1, 2024, the Government issued Decree 07/2024/ND-CP guiding the election, recruitment, use and management of officials working at communes, towns and ward-level officials of Ho Chi Minh City, Vietnam.

(1) The election, use, management, removal from office, relieve of duty, and removal of executive officials working at communes, wards, and towns in Ho Chi Minh City shall be carried out in accordance with the provisions of the Law on Officials 2008, the Law organizing the local Government 2015, the Law on election of deputies to the National Assembly and People’s Councils 2015, and other relevant laws, regulations, party regulations, and socio-political organization regulations at the central level.

(2) After the competent authority approves the election results or appoints executive officials at commune level, the People's Committee of Ho Chi Minh City shall, based on the professional and technical criteria of the official rank, issue a decision on appointment to the official rank and salary placement for the commune-level officials. This decision shall have the same validity as a decision to recruit officials for cases where the individuals are not yet officials, for consideration of assignment and task allocation as stipulated in point (4).

(3) The leadership position allowance for officials working at commune, ward, and town in Ho Chi Minh City shall be implemented in accordance with the government's regulations on commune-level officials, persons working on a part-time basis at the commune, hamlets, and residential groups.

(4) Upon request, assigned tasks, or when ceasing to hold a position (not during the disciplinary processing period), executive officials working at the commune, ward, and township level can be arranged, assigned, or transferred to work as officials at the commune, ward, and township level, or as officials from the district level and above, if they meet the criteria and conditions for the new position. The appointment to the official rank and salary placement in the new position shall be carried out in accordance with the provisions of the law on official management.

- The recruitment, use, management, training, development, evaluation, commendation, and disciplinary actions for officials working at the People's Committee of the commune or town shall be carried out in accordance with the provisions of the Law on Officials 2008 and the government's regulations on the recruitment, use, and management of civil servants.

- For the position of Chief Commander of the Commune Military Command, the recruitment and appointment shall be carried out in accordance with the provisions of Point dd Clause 1 of Article 23 of the Law on Militia and Self-defense Forces 2019 and the guiding documents. The appointment decision also serves as a decision to recruit officials for cases that are not yet official.
