Guidance on Implementing Maternity Policies for Male Employees

Official Dispatch 3432/LDTBXH-BHXH issued by the Ministry of Labor, War Invalids, and Social Affairs to address queries regarding certain issues in the implementation of social insurance benefits (BHXH) according to the Law on Social Insurance 2014.

Policies on paternal leave are guided as follows:

- Fathers are entitled to take paternal leave until their child reaches 6 months old in cases where the father participates in social insurance (regardless of the duration of social insurance contributions) and the mother encounters health problems post-birth, rendering her unable to care for the baby;- Male employees currently contributing to the compulsory social insurance fund for sickness and maternity benefits are entitled to paternal leave as per Clause 3, Article 34 of the Social Insurance Law. They are allowed to take leave multiple times, but the total leave period must not exceed the regulated duration.

The leave period for male employees is calculated within the first 30 days from the date their wife gives birth. In cases of multiple leave instances, the start date of the final leave instance must still fall within the first 30 days from the date the wife gives birth.

Additionally, the Official Dispatch provides guidance on the implementation of sickness policies, pension, death benefits policies, and voluntary social insurance.
